No. (2) of 2021
Concerning the Registration in the Register of Suppliers, Contractors, and Consultants at the Department of Finance in Ajman
We, Ammar bin Humaid Al Nuaimi, Crown Prince of the Emirate of Ajman,
Having reviewed:
Federal Law No. (2) of 2008 concerning Public Benefit Associations and Civil Society Organizations and its amendments,
And Law No. (1) of 2020 concerning Small and Medium Enterprises in the Emirate of Ajman,
And Emiri Decree No. (11) of 2011 issuing the Financial Law of the Government of Ajman and its executive regulations,
And Emiri Decree No. (15) of 2012 concerning the Department of Finance in Ajman and its amendments,
And Emiri Decree No. (2) of 2018 concerning the Legislation Committee in the Emirate of Ajman, and Emiri Decree No. (1) of 2019 concerning fees, taxes, and fines in the Emirate of Ajman,
And Emiri Decision No. (14) of 2013 concerning the fees for registration in the Register of Suppliers, Contractors, and Consultants at the Department of Finance in Ajman,
And Emiri Decision No. (22) of 2018 concerning the amendment of Emiri Decision No. (14) of 2013 regarding the fees for registration in the Register of Suppliers, Contractors, and Consultants at the Department of Finance in Ajman,
And based on the approval of the Legislation Committee,
We have issued the following decision:
Article (1) Definitions
The following words and phrases, wherever they appear in this Decision, shall have the meanings assigned to each of them, unless the context indicates otherwise:
The State: The United Arab Emirates.
The Emirate: The Emirate of Ajman.
The Department: The Department of Finance in Ajman.
Government Entity: Any department, institution, authority, council, agency, or any entity affiliated with the Government of the Emirate, whose budget is part of its annual budget.
The Register: The Register of Suppliers, Contractors, and Consultants established at the Department.
Supplier: An establishment licensed by the competent authority in the State to engage in the activity of supplying goods and commodities or providing services.
Contractor: An establishment licensed by the competent authority in the State to carry out construction and building works or to complete specific works.
Consultant: An establishment licensed by the competent authority in the State to practice consulting activities.
Ta'ziz: The Small and Medium Enterprises Program established at the Department of Economic Development in Ajman.
Article (2)
Registration in the Register
a. No government entity may contract with any supplier, contractor, or consultant unless they are registered in the Register.
b. The conditions, regulations, and procedures for registration in the Register, as well as cases for its cancellation and suspension, shall be determined by a decision issued by the Director-General of the Department.
Article (3)
Registration Fees in the Register
The Department shall collect a fee of (100) dirhams for the registration of a supplier, contractor, or consultant in the Register.
Article (4)
Exemptions
No registration fee shall be collected if the applicant is:
1. Registered in the "Ta'ziz" program.
2. Owned by a charitable association or a public benefit civil society organization.
3. Owned by one of the entities exempt from local fees.
4. Affiliated with or owned by any local or federal government entity.
5. An exclusive agent.
Article (5)
Devolution of Revenues
The proceeds of the fees collected under the provisions of this Decision shall devolve to the Government's Public Treasury account.
Article (6)
Repeals
a. The following two legislations are hereby repealed:
1. Emiri Decision No. (14) of 2013 concerning the fees for registration in the Register of Suppliers, Contractors, and Consultants at the Department of Finance in Ajman.
2. Emiri Decision No. (22) of 2018 concerning the amendment of Emiri Decision No. (14) of 2013 regarding the fees for registration in the Register of Suppliers, Contractors, and Consultants at the Department of Finance in Ajman.
b. Any text or provision contained in any other decision that contradicts or contravenes the provisions of this Decision shall be repealed.
Article (7)
Entry into Force and Publication
This Decision shall come into force as of April 1, 2021, and shall be published in the Official Gazette.
Issued by us on this day, Wednesday, 19th of Rajab 1442 AH, corresponding to the 3rd of March 2021 AD.
