بشأن
القيد في سجل الموردين والمقاولين والاستشاريين بدائرة المالية في عجمان
نحن عمار بن حميد النعيمي ولي عهد إمارة عجمان
بعد الاطلاع على القانون الاتحادي رقم (2) لسنة 2008 في شأن الجمعيات والمؤسسات الأهلية ذات النفع العام وتعديلاته،
وعلى القانون رقم (1) لسنة 2020 في شأن المشاريع والمنشآت الصغيرة والمتوسطة في إمارة عجمان،
وعلى المرسوم الأميري رقم (11) لسنة 2011 بإصدار القانون المالي لحكومة عجمان ولائحته التنفيذية،
وعلى المرسوم الأميري رقم (15) لسنة 2012 بشأن دائرة المالية في عجمان وتعديلاته،
وعلى المرسوم الأميري رقم (2) لسنة 2018 بشأن لجنة التشريعات في إمارة عجمان،
وعلى المرسوم الأميري رقم (1) لسنة 2019 بشأن الرسوم والضرائب والغرامات في إمارة عجمان،
وعلى القرار الأميري رقم (14) لسنة 2013 بشأن رسوم القيد في سجل الموردين والمقاولين والاستشاريين بدائرة المالية في عجمان،
وعلى القرار الأميري رقم (22) لسنة 2018 في شأن تعديل القرار الأميري رقم (14) لسنة 2013 بشأن رسوم القيد في سجل الموردين والمقاولين والاستشاريين بدائرة المالية في عجمان،
وبناءً على موافقة لجنة التشريعات،
أصدرنا القرار الآتي:
يكون للكلمات والعبارات التالية أينما وردت في هذا القرار المعاني المبينة قرين كُلٍ منها، ما لم يقضِ سياق النص بغير ذلك:

: دولة الإمارات العربية المتحدة. |
| الإمارة |
: إمارة عجمان. |
| الدائرة |
: دائرة المالية في عجمان. |
| جهة حكومية |
: أي دائرة أو مؤسسة أو هيئة أو مجلس أو جهاز أو أي جهة تتبع لحكومة الإمارة، وتكون موازنتها ضمن الموازنة السنوية لها. |
| السجل |
: سجل الموردين والمقاولين والاستشاريين المنشأ لدى الدائرة. |
| المورد |
: المنشأة المرخصة من السلطة المختصة في الدولة لممارسة نشاط توريد البضائع والسلع أو تقديم الخدمات. |
| المقاول |
: المنشأة المرخصة من السلطة المختصة في الدولة لممارسة أعمال التشييد والبناء أو إنجاز أعمالاً معينة. |
| الاستشاري |
: المنشأة المرخصة من السلطة المختصة في الدولة لممارسة الأنشطة الاستشارية. |
| تعزيز |
: برنامج المشاريع والمنشآت الصغيرة والمتوسطة المنشأ لدى دائرة التنمية الاقتصادية في عجمان. |
المادة (2)
القيد في السجل
أ. لا يجوز التعاقد مع أي مورد أو مقاول أو استشاري من قبل أي جهة حكومية ما لم يكن مقيداً في السجل.
ب. يُحدد بقرار يُصدره مدير عام الدائرة شروط وضوابط وإجراءات القيد في السجل، وحالات إلغائه ووقفه.
المادة (3)
رسوم القيد في السجل
تستوفي الدائرة نظير قيد المورد أو المقاول أو الاستشاري في السجل رسماً مقداره (100) درهم.
لا يُستوفى رسم نظير القيد في السجل، إذا كان طالب القيد:
- مسجلاً في برنامج "تعزيز".
- مملوكاً لجمعية خيرية أو مؤسسة أهلية ذات نفع عام.
- مملوكاً لإحدى الجهات المعفاة من الرسوم المحلية.
- تابعاً أو مملوكاً لأي جهة حكومية محلية أو اتحادية.
- وكيلاً حصرياً.
المادة (5)
أيلولة الإيرادات
تؤول حصيلة الرسوم التي يتم استيفاؤها بموجب أحكام هذا القرار لحساب الخزانة العامة للحكومة.
أ. يُلغى التشريعين الآتيين:
- القرار الأميري رقم (14) لسنة 2013 بشأن رسوم القيد في سجل الموردين والمقاولين والاستشاريين بدائرة المالية في عجمان.
- القرار الأميري رقم (22) لسنة 2018 في شأن تعديل القرار الأميري رقم (14) لسنة 2013 بشأن رسوم القيد في سجل الموردين والمقاولين والاستشاريين بدائرة المالية في عجمان.
ب. يُلغى أي نص أو حكم ورد في أي قرار آخر يتعارض أو يخالف أحكام هذا القرار.
المادة (7)
السريان والنشر
يُعمل بهذا القرار اعتباراً من 1 ابريل 2021، ويُنشر في الجريدة الرسمية.
صدر عنا في هذا اليوم الأربعاء 19 من شهر رجب 1442 هجرية الموافق 3 من شهر مارس سنة 2021 ميلادية.

Emiri Decision No. (2) of 2021
Regarding
Registration in the Register of Suppliers, Contractors, and Consultants at the Department of Finance in Ajman
We, Ammar bin Humaid Al Nuaimi, Crown Prince of the Emirate of Ajman,
Having reviewed Federal Law No. (2) of 2008 concerning Public Benefit Associations and Institutions and its amendments,
And Law No. (1) of 2020 concerning Small and Medium Enterprises and Establishments in the Emirate of Ajman,
And Emiri Decree No. (11) of 2011 issuing the Financial Law of the Government of Ajman and its executive regulations,
And Emiri Decree No. (15) of 2012 concerning the Department of Finance in Ajman and its amendments,
And Emiri Decree No. (2) of 2018 concerning the Legislation Committee in the Emirate of Ajman,
And Emiri Decree No. (1) of 2019 concerning Fees, Taxes, and Fines in the Emirate of Ajman,
And Emiri Decision No. (14) of 2013 concerning Registration Fees in the Register of Suppliers, Contractors, and Consultants at the Department of Finance in Ajman,
And Emiri Decision No. (22) of 2018 amending Emiri Decision No. (14) of 2013 concerning Registration Fees in the Register of Suppliers, Contractors, and Consultants at the Department of Finance in Ajman,
And based on the approval of the Legislation Committee,
We have issued the following Decision:
The following words and phrases, wherever they appear in this Decision, shall have the meanings assigned to each of them, unless the context indicates otherwise:

: The Emirate of Ajman. |
| The Department |
: The Department of Finance in Ajman. |
| Government Entity |
: Any department, institution, authority, council, agency, or any entity affiliated with the Government of the Emirate, whose budget is included in its annual budget. |
| The Register |
: The Register of Suppliers, Contractors, and Consultants established at the Department. |
| Supplier |
: An establishment licensed by the competent authority in the State to practice the activity of supplying goods and commodities or providing services. |
| Contractor |
: An establishment licensed by the competent authority in the State to carry out construction and building works or complete specific projects. |
| Consultant |
: An establishment licensed by the competent authority in the State to practice consulting activities. |
| Ta'ziz |
: The Small and Medium Enterprises and Establishments Program established at the Department of Economic Development in Ajman. |
Article (2)
Registration in the Register
A. No government entity may contract with any supplier, contractor, or consultant unless they are registered in the Register.
B. The conditions, regulations, and procedures for registration in the Register, as well as cases for its cancellation and suspension, shall be determined by a decision issued by the Director-General of the Department.
Article (3)
Registration Fees
The Department shall collect a fee of (100) Dirhams for the registration of a supplier, contractor, or consultant in the Register.
No fee shall be collected for registration in the Register if the applicant is:
- Registered in the "Ta'ziz" program.
- Owned by a charitable association or a public benefit civil institution.
- Owned by one of the entities exempt from local fees.
- Affiliated with or owned by any local or federal government entity.
- An exclusive agent.
Article (5)
Revenue Devolution
The proceeds from the fees collected under the provisions of this Decision shall be transferred to the Government's Public Treasury account.
A. The following two legislations are hereby repealed:
- Emiri Decision No. (14) of 2013 concerning Registration Fees in the Register of Suppliers, Contractors, and Consultants at the Department of Finance in Ajman.
- Emiri Decision No. (22) of 2018 amending Emiri Decision No. (14) of 2013 concerning Registration Fees in the Register of Suppliers, Contractors, and Consultants at the Department of Finance in Ajman.
B. Any text or provision contained in any other decision that contradicts or contravenes the provisions of this Decision is hereby repealed.
Article (7)
Entry into Force and Publication
This Decision shall come into force as of April 1, 2021, and shall be published in the Official Gazette.
Issued by us on this day, Wednesday, the 19th of Rajab 1442 Hijri, corresponding to the 3rd of March 2021 Gregorian.
