في شأن

الرسوم والمقابل المالي للخدمات المطبقة لدى هيئة دعم الخدمات الأمنية في عجمان

نحن عمار بن حميد النعيمي ولي عهد إمارة عجمان

بعد الاطلاع على المرسوم بقانون اتحادي رقم (26) لسنة 2019 في شأن المالية العامة للدولة،

بعد الاطلاع على المرسوم الأميري رقم (11) لسنة 2011 بإصدار القانون المالي لحكومة عجمان ولائحته التنفيذية،

وعلى المرسوم الأميري رقم (4) لسنة 2013 بشأن الشرطة المحلية في إمارة عجمان،

وعلى المرسوم الأميري رقم (4) لسنة 2014 بشأن إعادة تنظيم المجلس التنفيذي لإمارة عجمان وتعديلاته،

وعلى المرسوم الأميري رقم (1) لسنة 2017 بشأن إنشاء هيئة دعم الخدمات الأمنية في عجمان،

وعلى المرسوم الأميري رقم (2) لسنة 2018 بشأن لجنة التشريعات في إمارة عجمان،

وعلى المرسوم الأميري رقم (1) لسنة 2019 بشأن الرسوم والضرائب والغرامات في إمارة عجمان،

وعلى القرار الأميري رقم (6) لسنة 2015 بشأن رسوم الخدمات والغرامات المحلية المطبقة لدى شرطة عجمان،

وعلى القرار الأميري رقم (26) لسنة 2017 بشأن رسوم الخدمات والغرامات المحلية المطبقة لدى هيئة دعم الخدمات الأمنية في عجمان وتعديلاته،

وعلى قرار مجلس الوزراء رقم (30) لسنة 2017 في شأن خدمات السير والمرور والسلامة المرورية،

وبناءً على موافقة لجنة التشريعات،

أصدرنا القرار الآتي:

المادة (1)

اعتماد الرسوم والمقابل المالي

تستوفي هيئة دعم الخدمات الأمنية في عجمان، نظير الخدمات التي تقدمها ما يلي:

1. الرسوم المحدّدة في الجدول رقم (1) المرفق بهذا القرار.

2. المقابل المالي في الجدول رقم (2) المرفق بهذا القرار، ولمجلس الإدارة بقرار منه تحديد هذا المقابل وفقاً لاعتبارات سعر السوق ضمن الحدين الأدنى والأعلى المنصوص عليهما.

المادة (2)

أيلولة الإيرادات

تؤول حصيلة الرسوم التي يتم استيفاؤها بموجب أحكام هذا القرار لحساب الخزانة العامة لحكومة عجمان.

المادة (3)

الالغاءات

يلغى ما يأتي:

1. القرار الأميري رقم (26) لسنة 2017 بشأن رسوم الخدمات والغرامات المحلية المطبقة لدى هيئة دعم الخدمات الأمنية في عجمان.

2. القرار الأميري رقم (25) لسنة 2018 بتعديل بعض بنود القائمة رقم (1) المرفقة بالقرار الأميري رقم (26) لسنة 2017 بإصدار رسوم الخدمات والغرامات المحلية المطبقة لدى هيئة دعم الخدمات الأمنية في عجمان.

3. أي نص أو حكم ورد في أي قرار أخر يتعارض أو يخالف أحكام هذا القرار.

المادة (4)

السريان والنشر

يُعمل بهذا القرار بعد (30) يوماً من تاريخ صدوره، ويُنشر في الجريدة الرسمية.

صدر عنا في هذا اليوم الثلاثاء 24 من شهر جمادى الآخرة 1441 هجرية الموافق 18 من شهر فبراير سنة 2020 ميلادية.

Regarding

Fees and Financial Consideration for Services Provided by the Ajman Security Services Support Authority

We, Ammar bin Humaid Al Nuaimi, Crown Prince of the Emirate of Ajman

Having reviewed Federal Decree-Law No. (26) of 2019 concerning Public Finance of the State,

Having reviewed Emiri Decree No. (11) of 2011 issuing the Financial Law of the Government of Ajman and its executive regulations,

And upon Emiri Decree No. (4) of 2013 concerning the Local Police in the Emirate of Ajman,

And upon Emiri Decree No. (4) of 2014 concerning the reorganization of the Executive Council of the Emirate of Ajman and its amendments,

And upon Emiri Decree No. (1) of 2017 concerning the establishment of the Ajman Security Services Support Authority,

And upon Emiri Decree No. (2) of 2018 concerning the Legislation Committee in the Emirate of Ajman,

And upon Emiri Decree No. (1) of 2019 concerning Fees, Taxes, and Fines in the Emirate of Ajman,

And upon Emiri Decree No. (6) of 2015 concerning service fees and local fines applied by the Ajman Police,

And upon Emiri Decree No. (26) of 2017 concerning service fees and local fines applied by the Ajman Security Services Support Authority and its amendments,

And upon Cabinet Resolution No. (30) of 2017 concerning traffic, circulation, and road safety services,

And based on the approval of the Legislation Committee,

Have issued the following Decree:

Article (1)

Adoption of Fees and Financial Consideration

The Ajman Security Services Support Authority shall collect the following for the services it provides:

1. The fees specified in Schedule No. (1) attached to this Decree.

2. The financial consideration in Schedule No. (2) attached to this Decree. The Board of Directors may, by its decision, determine this consideration according to market price considerations within the minimum and maximum limits stipulated.

Article (2)

Devolution of Revenues

The proceeds of the fees collected under the provisions of this Decree shall be transferred to the public treasury account of the Government of Ajman.

Article (3)

Repeals

The following are repealed:

1. Emiri Decree No. (26) of 2017 concerning service fees and local fines applied by the Ajman Security Services Support Authority.

2. Emiri Decree No. (25) of 2018 amending some items of List No. (1) attached to Emiri Decree No. (26) of 2017 issuing service fees and local fines applied by the Ajman Security Services Support Authority.

3. Any text or provision contained in any other decree that contradicts or violates the provisions of this Decree.

Article (4)

Entry into Force and Publication

This Decree shall come into force (30) days after the date of its issuance and shall be published in the Official Gazette.

Issued by us on this day, Tuesday, 24th of Jumada al-Thani 1441 Hijri, corresponding to the 18th of February 2020.
