القرار الأميري رقم (٣) لسنة ٢٠١٨ م

بشأن رسوم خدمات قطاع الصحة العامة والبيئة في بلدية عجمان
وغرامات المخالفات المتعلقة بها

نحن، عمار بن حميد النعيمي، ولي عهد عجمان، رئيس المجلس التنفيذي بعجمان،

بعد الاطلاع على المرسوم الأميري رقم (١٤) لسنة ٢٠٠٦ بشأن إعادة تنظيم دائرة البلدية والتخطيط في عجمان؛ وعلى المرسوم الأميري رقم (١١) لسنة ٢٠١١ بإصدار القانون المالي لحكومة عجمان ولائحته التنفيذية والأنظمة والقرارات الصادرة بموجبه؛ وعلى المرسوم الأميري رقم (١٠) لسنة ٢٠١٤ بشأن إنشاء الإدارة المركزية للشؤون القانونية لحكومة عجمان؛ وعلى المرسوم الأميري رقم (١) لسنة ٢٠١٥ بشأن دائرة التنمية الاقتصادية؛ وعلى القرار الأميري رقم (١٢) لسنة ٢٠١٥ بشأن رسوم خدمات دائرة التنمية الاقتصادية في عجمان؛

والاطلاع على القرار الأميري رقم (٥) لسنة ٢٠١٧ بشأن رسوم خدمات النظافة العامة في عجمان وغرامات المخالفات المتعلقة بها؛

وبناءً على التوصيات المرفوعة لنا من رئيس دائرة البلدية والتخطيط في عجمان، بشأن تحديد الرسوم التي تتقاضاها الإدارات التابعة لقطاع الصحة العامة والبيئة في دائرة البلدية والتخطيط في عجمان، وتحديد غرامات المخالفات المتعلقة بها، وموافقة دائرة المالية في الإمارة على تلك التوصيات؛

ولما إرتأينا فيه تحقيق المصلحة العامة...

قررنا إصدار القرار الأميري الآتي نصه:

المادة (١)

إسم القرار وبدء العمل به

يسمى هذا القرار "القرار الأميري رقم (٣) لسنة ٢٠١٨، بشأن رسوم خدمات قطاع الصحة العامة والبيئة في بلدية عجمان وغرامات المخالفات المتعلقة بها" ويعمل به إعتباراً من اليوم الأول من شهر يونيو سنة ٢٠١٨.

المادة (٢)

تعريفات

لأغراض تطبيق هذا القرار الأميري، وما لم يقتض سياق النص معنى آخر، تكون للكلمات والعبارات التالية، المعاني المبينة قرين كل منها أدناه، على النحو الآتي:

"الدولة" : يقصد بها دولة الإمارات العربية المتحدة.

"الإمارة" : يقصد بها إمارة عجمان.

"دائرة البلدية" : يقصد بها دائرة البلدية والتخطيط في عجمان.

"قطاع الصحة والبيئة" : يقصد به قطاع الصحة العامة والبيئة في دائرة البلدية.

المادة (٣)

رسوم الخدمات

٣(١) إعتباراً من تاريخ نفاذ هذا القرار الأميري:

(أ) تتقاضى إدارة الصحة العامة - قطاع الصحة والبيئة، رسوم الخدمات الواردة تحديداً في القائمة رقم (١) المرفقة بهذا القرار الأميري وذلك في نظير الخدمات التي تقدمها الإدارة المذكورة للمستفيدين من تلك الخدمات.

(ب) تتقاضى إدارة البيئة وتنميتها - قطاع الصحة والبيئة، رسوم الخدمات الواردة تحديداً في القائمة رقم (٢)، المرفقة بهذا القرار الأميري، وذلك في نظير الخدمات التي تقدمها الإدارة المذكورة للمستفيدين من تلك الخدمات.

(ج) تتقاضى إدارة الزراعة والحدائق - قطاع الصحة والبيئة، رسوم الخدمات الواردة تحديداً في القائمة رقم (٣)، المرفقة بهذا القرار الأميري، وذلك في نظير الخدمات التي تقدمها الإدارة المذكورة للمستفيدين من تلك الخدمات.

(د) تتقاضى إدارة مختبر الأغذية البيئة - قطاع الصحة والبيئة، رسوم الخدمات الواردة في القائمة رقم (٤)، المرفقة بهذا القرار الأميري، وذلك في نظير الخدمات التي تقدمها الإدارة المذكورة للمستفيدين من تلك الخدمات.

٣(٢) تحسب كافة الرسوم المحصلة بموجب الفقرات (أ) و(ب) و(ج) و(د) من المادة ٣ (١) أعلاه، ضمن الإيرادات السنوية لدائرة البلدية، وتورد للخزانة العامة في الإمارة.

المادة (٤)

ضبط المخالفات وتوقيع وتحصيل الغرامات

٤(١) إعتباراً من تاريخ نفاذ هذا القرار الأميري:

(أ) تختص إدارة الصحة العامة - قطاع الصحة والبيئة، بضبط وإثبات المخالفات الواردة تحديداً في القائمة رقم (٥) المرفقة بهذا القرار الأميري، ويكون لها الحق في توقيع وتحصيل الغرامة المقررة عن كل مخالفة من تلك المخالفات.

(ب) تختص إدارة البيئة وتنميتها - قطاع الصحة والبيئة، بضبط وإثبات المخالفات الواردة تحديداً في القائمة رقم (٦) المرفقة بهذا القرار الأميري، ويكون لها الحق في توقيع وتحصيل الغرامة المقررة عن كل مخالفة من تلك المخالفات.

(ج) تختص إدارة الزراعة والحدائق العامة - قطاع الصحة والبيئة، بضبط وإثبات المخالفات الواردة تحديداً في القائمة رقم (٧) المرفقة بهذا القرار الأميري، ويكون لها الحق في توقيع وتحصيل الغرامة المقررة عن كل مخالفة من تلك المخالفات.

٤ (٢) تحسب كافة الغرامات المحصلة بموجب الفقرات (أ) و(ب) و(ج) من المادة ٤ (١) أعلاه، ضمن الإيرادات السنوية لدائرة البلدية، وتورد للخزانة العامة في الإمارة.

المادة (٥)

سلطات مأموري الضبط القضائي

يصدر رئيس دائرة البلدية قراراً إدارياً بأسماء مفتشي دائرة البلدية الذين يتم منحهم صفة مأموري الضبط القضائي، وفقاً لأحكام التشريعات السارية في الدولة وفي الإمارة، ويكون لهم الحق في القيام بضبط وإثبات وتدوين الأفعال والوقائع التي تشكل مخالفة لنظم دائرة البلدية حسبما تم ذكرها تحديداً في القوائم رقم (٥) و(٦) و(٧) المرفقة بهذا القرار الأميري.

المادة (٦)

إلغاء أحكام التشريعات المخالفة

إعتباراً من تاريخ نفاذ هذا القرار الأميري، يلغى أي نص أو حكم ورد في أي تشريع محلي، ساري المفعول حالياً في الإمارة، يخالف الأحكام الواردة في هذا القرار الأميري، وذلك بقدر ما قد يكون مطلوباً لإزالة المخالفة في الحكم المعني مع أحكام هذا القرار الأميري.

المادة (٨)

نشر القرار الأميري وتعميمه

يُنشر هذا القرار في الجريدة الرسمية للإمارة، ويتم تعميمه على كافة الجهات المعنية به للعمل بموجبه، كل فيما يخصها.

صدر عنا بتوقيعنا وخاتمنا عليه، بمكتبنا بالديوان الأميري في عجمان، في هذا اليوم الأحد غرة رجب سنة ١٤٣٩ هجرية الموافق اليوم الثامن عشر من شهر مارس سنة ٢٠١٨ ميلادية.

Emiri Decree No. (3) of 2018

Concerning the Fees for Public Health and Environment Sector Services in Ajman Municipality
and Related Violation Fines

We, Ammar bin Humaid Al Nuaimi, Crown Prince of Ajman, Chairman of the Ajman Executive Council,

Having reviewed Emiri Decree No. (14) of 2006 concerning the reorganization of the Municipality and Planning Department in Ajman; and Emiri Decree No. (11) of 2011 issuing the Financial Law of the Government of Ajman, its executive regulations, and the systems and decisions issued thereunder; and Emiri Decree No. (10) of 2014 concerning the establishment of the Central Administration for Legal Affairs for the Government of Ajman; and Emiri Decree No. (1) of 2015 concerning the Department of Economic Development; and Emiri Decree No. (12) of 2015 concerning the service fees of the Department of Economic Development in Ajman;

And having reviewed Emiri Decree No. (5) of 2017 concerning public cleaning service fees in Ajman and related violation fines;

And based on the recommendations submitted to us by the Chairman of the Municipality and Planning Department in Ajman, regarding the determination of fees charged by the departments of the Public Health and Environment Sector in the Municipality and Planning Department in Ajman, and the determination of related violation fines, and the approval of the Department of Finance in the Emirate on those recommendations;

And for what we have deemed to be in the public interest...

We have decided to issue the following Emiri Decree:

Article (1)

Name of the Decree and its Entry into Force

This Decree shall be named "Emiri Decree No. (3) of 2018, concerning the Fees for Public Health and Environment Sector Services in Ajman Municipality and Related Violation Fines" and shall come into force from the first day of June 2018.

Article (2)

Definitions

For the purposes of implementing this Emiri Decree, and unless the context otherwise requires, the following words and phrases shall have the meanings assigned to them below:

"The State": means the United Arab Emirates.

"The Emirate": means the Emirate of Ajman.

"The Municipality Department": means the Municipality and Planning Department in Ajman.

"The Health and Environment Sector": means the Public Health and Environment Sector in the Municipality Department.

Article (3)

Service Fees

3(1) As of the effective date of this Emiri Decree:

(a) The Public Health Department - Health and Environment Sector, shall charge the service fees specified in List No. (1) attached to this Emiri Decree in return for the services provided by the said department to the beneficiaries of those services.

(b) The Environment and Development Department - Health and Environment Sector, shall charge the service fees specified in List No. (2) attached to this Emiri Decree in return for the services provided by the said department to the beneficiaries of those services.

(c) The Agriculture and Parks Department - Health and Environment Sector, shall charge the service fees specified in List No. (3) attached to this Emiri Decree in return for the services provided by the said department to the beneficiaries of those services.

(d) The Food and Environment Laboratory Department - Health and Environment Sector, shall charge the service fees specified in List No. (4) attached to this Emiri Decree in return for the services provided by the said department to the beneficiaries of those services.

3(2) All fees collected under paragraphs (a), (b), (c), and (d) of Article 3(1) above shall be counted within the annual revenues of the Municipality Department and shall be deposited into the public treasury of the Emirate.

Article (4)

Recording Violations and Imposing and Collecting Fines

4(1) As of the effective date of this Emiri Decree:

(a) The Public Health Department - Health and Environment Sector, shall be responsible for recording and proving the violations specified in List No. (5) attached to this Emiri Decree, and shall have the right to impose and collect the prescribed fine for each of those violations.

(b) The Environment and Development Department - Health and Environment Sector, shall be responsible for recording and proving the violations specified in List No. (6) attached to this Emiri Decree, and shall have the right to impose and collect the prescribed fine for each of those violations.

(c) The Agriculture and Public Parks Department - Health and Environment Sector, shall be responsible for recording and proving the violations specified in List No. (7) attached to this Emiri Decree, and shall have the right to impose and collect the prescribed fine for each of those violations.

4(2) All fines collected under paragraphs (a), (b), and (c) of Article 4(1) above shall be counted within the annual revenues of the Municipality Department and shall be deposited into the public treasury of the Emirate.

Article (5)

Powers of Judicial Officers

The Chairman of the Municipality Department shall issue an administrative decision with the names of the Municipality Department inspectors who are granted the capacity of judicial officers, in accordance with the provisions of the applicable legislation in the State and the Emirate. They shall have the right to record, prove, and document acts and facts that constitute a violation of the Municipality Department's regulations as specifically mentioned in Lists No. (5), (6), and (7) attached to this Emiri Decree.

Article (6)

Repeal of Conflicting Legislative Provisions

As of the effective date of this Emiri Decree, any text or provision in any local legislation currently in force in the Emirate that conflicts with the provisions of this Emiri Decree shall be repealed, to the extent required to remove the conflict between the relevant provision and the provisions of this Emiri Decree.

Article (8)

Publication and Circulation of the Emiri Decree

This Decree shall be published in the Official Gazette of the Emirate and shall be circulated to all concerned parties to act upon it, each within its jurisdiction.

Issued by us with our signature and seal, at our office in the Emiri Diwan in Ajman, on this day, Sunday, the first of Rajab 1439 Hijri, corresponding to the eighteenth day of March 2018 Gregorian.
