بعد الإطلاع على المرسوم الأميري رقم (۳) لسنة ۲۰۱۰ بشأن جهاز عجمان للرقابة المالية؛ وعلى المرسوم الأميري رقم (۱۱) لسنة ۲۰۱۱ بإصدار القانون المالي لحكومة عجمان؛ وعلى المرسوم الأميري رقم (٤) لسنة ٢٠١٤ بشأن إعادة تنظيم المجلس التنفيذي في إمارة عجمان؛ وعلى المرسوم الأميري رقم (١٠) لسنة ٢٠١٤ بشأن إنشاء الإدارة المركزية للشؤون القانونية.

ورغبة منا في تبسيط وتسهيل واستعجال إجراءات المعاملات والخدمات التي تقدمها الجهات الحكومية لجمهور المتعاملين معها، بهدف تحسين بيئة الأعمال الحكومية في الإمارة، وتحقيق أعلى درجات رضا المتعاملين، والارتقاء بتنافسية الإمارة في جذب المستثمرين، مما يتوافق مع رؤية وإستراتيجية حكومة عجمان لتحقيق التنمية المستدامة فيها.

وبمقتضى الصلاحيات الممنوحة لنا من صاحب السمو حاكم الإمارة والتي تخولنا إصدار مراسيم أميرية في حال غياب سموه خارج البلاد.

ولما ارتأينا فيه تحقيق المصلحة العامة؛

أصدرنا المرسوم الأميري الآتي نصه

يسمى هذا المرسوم المرسوم الأميري رقم (٤) لسنة ٢٠١٦ بشأن تفويض صلاحيات الجهات الحكومية" ويعمل به إعتباراً من تاريخ التوقيع عليه.

لأغراض تطبيق هذا المرسوم تكون للكلمات والعبارات التالية، حيثما وردت في هذا المرسوم، المعاني المبينة أمام كل منها أدناه، ما لم يدل سياق النص على خلاف ذلك:

"الإمارة:": إمارة عجمان.

"جهة حكومية": المجلس التنفيذي، وأي دائرة محلية، أو هيئة، أو مؤسسة، أو إدارة تابعة لحكومة الإمارة، وتقوم بإنجاز معاملات أو تقديم خدمات لجمهور المتعاملين معها. وتشمل العبارة منطقة عجمان الحرة ومدينة عجمان الإعلامية الحرة.

"دائرة المالية": دائرة المالية التابعة لحكومة الإمارة.

"الرئيس": القيادي الأعلى المعين لرئاسة الجهة الحكومية المعنية ويشمل التعريف المدير العام أو المدير التنفيذي أو مدير الإدارة للجهة الحكومية في حال عدم تعيين رئيس لها أو غياب رئيسها خارج الدولة.

بموجب هذا المرسوم يجوز للرئيس، في أي جهة حكومية، وبموجب قرار خطي يصدره، تفويض بعض صلاحيات الجهة الحكومية المعنية المتعلقة بإنجاز المعاملات، أمامها، أو بتقديم خدماتها للغير، إلى أي جهة حكومية أخرى، أو الى أي شركة أو مؤسسة خاصة، وذلك بهدف تبسيط وتسهيل واستعجال الإجراءات. ويشترط لنفاذ قرار التفويض المذكور قيام الجهة الحكومية المعنية بإبرام اتفاقية خطية مع الجهة المفوضة اليها الصلاحيات وأن توافق دائرة المالية على تلك الإتفاقية خطياً ومسبقاً.

ينشر هذا المرسوم الأميري في الجريدة الرسمية للإمارة ويعمم على كافة الجهات المعنية بتنفيذه للعمل بمقتضاه كل فيما يخصه.

(4) of 2016

Concerning the Delegation of Powers of Government Entities

We, Ammar bin Humaid Al Nuaimi, Crown Prince of Ajman, Chairman of the Executive Council.

Having perused Emiri Decree No. (3) of 2010 concerning the Ajman Financial Control Authority; and Emiri Decree No. (11) of 2011 issuing the Financial Law of the Government of Ajman; and Emiri Decree No. (4) of 2014 concerning the reorganization of the Executive Council in the Emirate of Ajman; and Emiri Decree No. (10) of 2014 concerning the establishment of the Central Department for Legal Affairs.

And desiring to simplify, facilitate, and expedite the procedures for transactions and services provided by government entities to their clients, with the aim of improving the government business environment in the Emirate, achieving the highest levels of customer satisfaction, and enhancing the Emirate's competitiveness in attracting investors, in line with the vision and strategy of the Government of Ajman to achieve sustainable development therein.

And pursuant to the powers vested in us by His Highness the Ruler of the Emirate, which authorize us to issue Emiri Decrees in the event of His Highness's absence abroad.

And for what we have deemed to be in the public interest;

We have issued the following Emiri Decree:

Article (1)

Name of the Decree and its Entry into Force

This Decree shall be named "Emiri Decree No. (4) of 2016 Concerning the Delegation of Powers of Government Entities" and shall come into force from the date of its signature.

Article (2)

Definitions

For the purposes of applying this Decree, the following words and phrases, wherever mentioned herein, shall have the meanings assigned to each of them below, unless the context indicates otherwise:

"The Emirate": The Emirate of Ajman.

"Government Entity": The Executive Council, and any local department, authority, institution, or administration affiliated with the government of the Emirate, which processes transactions or provides services to its clients. The phrase includes the Ajman Free Zone and the Ajman Media City Free Zone.

"Department of Finance": The Department of Finance of the government of the Emirate.

"The Head": The highest-ranking leader appointed to preside over the concerned government entity, and the definition includes the Director General, Executive Director, or Department Director of the government entity in the event a head has not been appointed for it or its head is absent from the country.

Article (3)

Delegation of Certain Powers

Pursuant to this Decree, the Head of any government entity may, by a written decision issued by him, delegate some of the powers of the concerned government entity related to processing transactions before it, or providing its services to others, to any other government entity, or to any private company or establishment, with the aim of simplifying, facilitating, and expediting procedures. For the said delegation decision to be effective, it is required that the concerned government entity concludes a written agreement with the entity to which the powers are delegated and that the Department of Finance approves that agreement in writing and in advance.

Article (4)

Publication and Circulation of the Decree

This Emiri Decree shall be published in the Official Gazette of the Emirate and circulated to all concerned entities for its implementation, each within its own jurisdiction.
