المقدمة

يعد نظام الدوام المرن من الممارسات الحديثة نسبيا في دولة الامارات العربية المتحدة ويشكل الانضباط في الحضور والانصراف القاسم المشترك والذي له تأثير في انتاجية الموظفين والعاملين في القطاع الحكومي وفي ظل اهمية الوعي بالمعنى الحقيقي للالتزام ، جاءت فكرة تطبيق الدوام المرن للموظفين لكي يتلاءم مع بعض المتطلبات الخاصة بهم .

هذا النظام سيكون نافعا جدا من خلال توفير المرونة المطلوبة للموظفين الذين يرتبطون بمسؤوليات عائلية او شخصية وكذلك العملاء من خلال تنوع في ساعات العمل للجهة الحكومية مما يعني خدمات افضل وجودة اكبر وبالتالي المساهمة في زيادة رضا الموظفين والعملاء بنفس الوقت. وعليه قامت الإدارة المركزية لتنمية الموارد البشرية بإعداد نظام الدوام المرن بما يتلائم مع احتياجات وظروف الموظفين ويؤدي إلى الاستقرار الوظيفي وتوفير بيئة عمل مناسبة للموظفين ويرفع من مستوى الانتاجية والكفاءة والولاء.

التعريفات

الحكومة : حكومة إمارة عجمان
الادارة المركزية: الادارة المركزية لتنمية الموارد البشرية في عجمان المنشأة بالمرسوم الأميري رقم (16) لسنة 2012.
الجهة الحكومية : أية دائرة أو مؤسسة أو هيئة أو إدارة منفصلة أو منشأة أخرى تابعة لحكومة الإمارة .
وحدة الموارد البشرية : الوحدات التنظيمية المعنية بشؤون الموارد البشرية في الدوائر الحكومية المحلية ، المشمولة بتطبيق نظام الدوام المرن.
قانون الخدمة المدنية : المرسوم الأميري رقم (9) لسنة 2008 بشأن اصدار قانون الخدمة المدنية في إمارة عجمان ولائحته التنفيذية.
الموظف : يقصد به كل من يشغل إحدى الوظائف الواردة في الموازنة .
الدوام المرن: نظام ساعات عمل مرنة للموظفين يحافظ على نفس معدل ساعات العمل الرسمية المقررة حسب قانون الموارد البشرية ولائحته التنفيذية ويراعي ظروف واحتياجات الموظف.
النظام : نظام الدوام المرن في حكومة عجمان.

أهداف نظام الدوام المرن

يهدف نظام الدوام المرن الى :

زيادة الولاء الوظيفي للموظف في الجهات الحكومية .
دعم الموظفين وتحفيزهم من خلال توفير المرونة في اوقات العمل بهدف زيادة الانتاج ومساعدة الموظفين في تحقيق اهدافهم.
المساعدة في استيعاب التاخير البسيط الذي يحدث احيانا عند بعض الموظفين لاسباب خارجة عن ارادتهم وبنفس الوقت السماح لهم بتعويضها من خلال نظام الدوام المرن.
توفير حلول للكثير من الإشكاليات التي يلقى بها على عاتق الموظفين الذين يكون لديهم مسؤوليات وإرتباطات أخرى.
تقليص نسب الغياب ونسب الإستئذان للموظفين للخروج في أذونات شخصية حيث يعمل الموظفون على تنسيق أوقات عملهم مع متطلباتهم والتزاماتهم الشخصية.
خلق ثقافة مؤسسية تربط بين حاجات الموظف واهداف الجهة الحكومية من خلال المرونة التي يوفرها نظام الدوام المرن وتعزيز الإحساس بالمسؤولية بأهمية الوقت للموظفين خلال ساعات العمل الرسمي.
الحفاظ على الموارد البشرية من خلال تحسين بيئة العمل في الجهات الحكومية لما لها تأثير جسماني ونفسي على الموظفين.

نطاق التطبيق

يكون الموظفون المشمولون بتطبيق النظام هم الموظفين بالدوائر والهيئات والمؤسسات والادارات التي تطبق قانون الخدمة المدنية في ضوء الاحكام والشروط الواردة فيه.
يجوز اضافة اي جهة داخل إمارة عجمان ليشملها النظام بموافقة كتابية من ممثل الحاكم للشؤون الادارية والمالية ، على أن يسبق ذلك قيام الادارة المركزية بإعداد دراسة شاملة بشأن الحاجة لتطبيق نظام الدوام المرن لديها وعرضها على ممثل الحاكم للشؤون الادارية والمالية لاتخاذ ما يراه مناسباً.
تلتزم الجهات المشمولة بتطبيق النظام بتنفيذ الاجراءات والتعليمات التي تصدر لها من الادارة المركزية بخصوص تطبيق النظام .

الفوائد المرجوة من نظام الدوام المرن

تخفيف الضغط على الخدمات التي تقدمها الدائرة .
المساهمة في زيادة الرضا الوظيفي للعاملين في الجهات الحكومية .
المساعدة في توفير خدمات أفضل للمتعاملين.
تطوير القدرة الانتاجية لدى الموظفين وتحسين الاداء اليومي من خلال اتاحه الفرصة للموظف في إنجاز أعماله في الوقت الذي تكون قدرته الإنتاجية أعلى.
التأثير الايجابي على الاسرة وبالتالي المجتمع .
تخفيف الأعباء الإدارية على إدارات الموارد البشرية في الجهات الحكومية ( الجزاءات و الغياب ) وتقليل عدد أذونات الحضور والانصراف.

واجبات الادارة المركزية

تتولى الادارة المركزية الإشراف على تنفيذ أحكام هذا الدليل ويكون لها في سبيل ذلك القيام بما يلي :

إعداد وتطوير النظام ووضع الخطط اللازمة لتنفيذه.
التأكد من قيام وحدات الموارد البشرية بمهامها المنصوص عليها في هذا النظام.
التنسيق مع الدائرة المالية لموائمة نظام موارد مع الدليل.
مراجعة وإعادة تقييم النظام وذلك بشكل سنوي أو كلما دعت الحاجة، وتقديم نتائج هذه المراجعات والاقتراحات إلى ممثل الحاكم لاعتمادها.

آلية العمل بالنظام

يتم العمل بنظام الدوام المرن حسب التالي:

يتم تقسيم وقت عمل الموظفين داخل الجهة الحكومية على فترات متفاوتة للحضور والانصراف. تعتبر ساعات العمل الرسمية والتي تبدأ من الساعة 7:30 و حتى 2:30 ظهرا هي الأساسية وما عداها تعتبر أوقات عمل رسمية مرنة كما هو موضح أدناه ، على أن يلتزم الموظف بسبع ساعات عمل متصلة من وقت حضوره الفعلي:
1. وقت دخول الموظفين: من الساعه 7:00 صباحا - 8:30 صباحا
2. وقت خروج الموظفين: من الساعة 2:00 ظهرا - 3:30 ظهرا.
موعد الحضور للدوام الرسمي في شهر رمضان يبدأ من الساعة 09:00 صباحا وحتى الساعة 02:00 ظهرا وماعداها تعتبر أوقات عمل رسمية مرنة كما هو موضح أدناه ، على أن يلتزم الموظف بخمس ساعات عمل متصلة من وقت حضوره الفعلي:
1. وقت دخول الموظفين: من الساعه 8:00 صباحا - 10:00 صباحا
2. وقت خروج الموظفين: من الساعة 1:00 ظهرا - 3:00 ظهرا.
على موظفي خدمة العملاء الالتزام بأوقات العمل الرسمية وذلك من الساعة 07:30 صباحا حتى الساعة 02:30 ظهرا، إلا إذا ارتأت الجهة الحكومية امكانية تمتع موظفيها في قسم خدمة العملاء أو أي وظيفة لها علاقة أو ارتباط بالجمهور بنظام الدوام المرن، وذلك دون المساس بحسن سير العمل في الجهة الحكومية.

1	المدير العام	إعتماد اللوائح الداخليه والقرارات اللازمة لتطبيق نظام الدوام المرن في الدائرة بما لا يتعارض مع هذا النظام.
2	مدير الإدارة	الاشراف على تطبيق نظام الدوام المرن بشكل صحيح.
3	الرئيس المباشر للموظف	التنسيق مع الموظفين لتطبيق نظام الدوام المرن بما يتناسب مع طبيعة عمل الادارة ولا يضر بسير العمل.
4	وحدة الموارد البشرية	إعادة تنظيم العمل بساعات الدوام الجديدة للموظفين. قياس مدى فعالية النظام بالدائرة وذلك بالتنسيق مع الإدارة المركزية. تعريف الموظفين عن النظام المرن وآليه تطبيقه الإجابة عن أي استفسارات للموظفين حول النظام.
5	الموظف	الحصول على الموافقة المسبقة من الرئيس المباشر بشأن اختيار وقت الدوام المرن المناسب. أن يكون قادراً على الوفاء بمتطلبات وأعباء العمل. استخدام وقت العمل الرسمي بفعالية. الإلتزام بإستخدام نظام الحضور والانصراف.

الأذن الشخصي

يجوز لكل موظف أخذ أذن خروج شخصي بعذر ولا يتجاوز 3 ساعات كحد أقصى مرة واحدة في اليوم على أن يكون الحد الأدنى للاذن الشخصي مدة 30 دقيقة، وفي حال تجاوز 3 ساعات فيتم خصم يوم من الراتب الأساسي للموظف، ولا يعتبر حقاً مكتسبا للموظف ويتم استخدامه في الحالات الضرورية وذلك بعد الاعتمادات اللازمة.
لا يجوز أن تتجاوز ساعات الأذن الشخصي عن 7 ساعات في الشهر الواحد.
تطبيق الجزاءات الخاصة بالتأخير والغياب حسب ما ورد في المادة 17 من اللائحة التنفيذية في حال تأخر الموظف من وقت بدء ساعات العمل الأساسية أو ساعات العمل الرسمية المرنة بدون عذر مقبول.

الأذن الدراسي

يجوز منح الموظف استراحة دراسة قصيرة لمدة ساعتين يوميا كحد أقصى لحضور الحصص الدراسية في أي برنامج دراسي معتمد وذلك حتى انتهاء ذلك البرنامج، على أن تبدأ فترة السماح لاستخدام الأذن الدراسي من الساعة 12:30 وعلى أن يتم التزامه بحضور خمس ساعات عمل رسمية كحد أدنى قبل خروجه من الدائرة، كما يجوز الجمع بين الأذن الدراسي والأذن الشخصي على أن لا يتجاوز 3 ساعات عمل.

ساعة الرضاعة

تمنح الموظفة بعد انقضاء اجازة الوضع فترة ساعة واحدة يوميا لإرضاع مولودها وذلك لمدة سنة كاملة بعد تاريخ نهاية اجازة الوضع ويجوز زيادة تلك المدة لفترة اقصاها ثلاثة اشهر بتوصية خطية صادرة من مستشفى معتمد. وتحتسب الساعة المذكورة ضمن ساعات العمل براتب اجمالي كامل.

قياس أثر تطبيق النظام

تقوم وحدة الموارد البشرية بالدائرة المعنية وبالتنسيق مع الإدارات المعنية في الدائرة والمطبقة للنظام وذلك للقيام بالمراجعة الدورية لتقييم مدى جودة تطبيق النظام وابداء الملاحظات والمقترحات لتطويره و التعرف على مدى رضا الموظفين . ورفع التقرير اللازمة للادارة المركزية.

إرشادات عامة

من أجل نجاح النظام في الدوائر الحكومية يجب اتباع الإرشادات التالية:

قيام رؤساء الوحدات التنظيمية بتنظيم خيارات الموظفين بالشكل الذي لا يؤثر على انسيابية عمل الجهة الحكومية.
يتعين على جميع الجهات الحكومية الإلتزام باستخدام النظام الإلكتروني المعتمد لدى حكومة عجمان لضبط عملية حضور وانصراف الموظفين خلال وأثناء الدوام الرسمي .
يجوز للسلطة المختصة استثناء فئات معينة تتطلب طبيعة عملهم التواجد بمقر العمل في بداية الدوام الرسمي كي لا تتأثر الخدمات التي تقدمها المكاتب والإدارات في الجهات الحكومية بهذا التطبيق.
يجوز للجهة الحكومية تحديد تعليمات داخلية للعمل بنظام الدوام المرن شرط ان لا تتجاوز الاطار العام لهذا الدليل .
على الوحدات التنظيمية في الجهة الحكومية التنسيق مع وحدة الموارد البشرية بشأن اختيار الوقت المناسب للموظفين وذلك بعد أخذ الإعتمادات اللازمة.
يتوجب على جميع الموظفين إكمال ساعات العمل اليومية.
الموظفون الذين يعملون ساعات عمل إضافية يستحقون التعويض عن ساعات العمل الإضافية التي يتم تكليفهم بها من قبل الجهة الحكومية وذلك وفقا للشروط والاحكام المحددة بقانون الخدمة المدنية ولائحته التنفيذية.
على وحدة الموارد البشرية وضع آلية محددة لنشر النظام وزيادة الوعي لدى الموظفين بأهداف النظام وتحديد طريقة عمل النظام والهدف المنشور من تحقيقه حتى تصبح الأنماط السلوكية والإجراءات المطبقة ثابته وراسخة في ثقافة بيئة العمل.
تعد مخالفات الدوام المرن جزء من مخالفات الدوام الرسمي ويطبق عليها المخالفات والجزاءات الواردة في قانون الخدمة المدنية واللائحة التنفيذية.
تقوم وحدة الموارد البشرية بقياس تطبيق نظام الدوام المرن من خلال نسب الرضا الوظيفي على النظام ومدى التزام الموظفين بالتقيد بساعات العمل الرسمية.
يجوز للموظف أخذ الأذن الشخصي أو الأذن الدراسي خلال شهر رمضان بناءً على الاجراءات المعتمدة في هذا الدليل.
تمنح الموظفة ساعة الرضاعة خلال الدوام الرسمي في شهر رمضان.

Introduction

The flexible working hours system is a relatively modern practice in the United Arab Emirates. Discipline in attendance and departure is the common denominator that affects the productivity of employees and workers in the government sector. In light of the importance of awareness of the true meaning of commitment, the idea of applying flexible working hours for employees was introduced to accommodate some of their special requirements.

This system will be very beneficial by providing the required flexibility for employees who have family or personal responsibilities, as well as for customers through a variety of working hours for the government entity, which means better services and greater quality, thus contributing to increasing the satisfaction of both employees and customers. Accordingly, the Central Human Resources Development Department has prepared the flexible working hours system to suit the needs and circumstances of employees, leading to job stability, providing a suitable work environment for employees, and raising the level of productivity, efficiency, and loyalty.

Definitions

Government: The Government of the Emirate of Ajman
Central Department: The Central Human Resources Development Department in Ajman, established by Emiri Decree No. (16) of 2012.
Government Entity: Any department, institution, authority, separate administration, or other establishment belonging to the Emirate's government.
Human Resources Unit: The organizational units concerned with human resources affairs in local government departments, included in the application of the flexible working hours system.
Civil Service Law: Emiri Decree No. (9) of 2008 regarding the issuance of the Civil Service Law in the Emirate of Ajman and its executive regulations.
Employee: Refers to everyone who occupies one of the positions listed in the budget.
Flexible Working Hours: A flexible working hours system for employees that maintains the same rate of official working hours as prescribed by the Human Resources Law and its executive regulations, and takes into account the employee's circumstances and needs.
The System: The Flexible Working Hours System in the Government of Ajman.

Objectives of the Flexible Working Hours System

The flexible working hours system aims to:

Increase employee job loyalty in government entities.
Support and motivate employees by providing flexibility in working hours to increase productivity and help employees achieve their goals.
Help accommodate minor delays that sometimes occur for some employees for reasons beyond their control, while allowing them to compensate for it through the flexible working hours system.
Provide solutions for many of the issues faced by employees who have other responsibilities and commitments.
Reduce absenteeism and personal leave rates as employees coordinate their work schedules with their personal requirements and commitments.
Create a corporate culture that links the employee's needs with the government entity's objectives through the flexibility provided by the system, and enhance the employees' sense of responsibility for the importance of time during official working hours.
Retain human resources by improving the work environment in government entities, which has a physical and psychological impact on employees.

Scope of Application

The employees covered by the system are the employees in departments, authorities, institutions, and administrations that apply the Civil Service Law in light of the provisions and conditions contained therein.
Any entity within the Emirate of Ajman may be added to be covered by the system with written approval from the Ruler's Representative for Administrative and Financial Affairs, provided that the Central Department first prepares a comprehensive study on the need to apply the flexible working hours system and presents it to the Ruler's Representative for Administrative and Financial Affairs to take appropriate action.
Entities covered by the system are committed to implementing the procedures and instructions issued to them by the Central Department regarding the application of the system.

Expected Benefits of the Flexible Working Hours System

Reducing pressure on the services provided by the department.
Contributing to increasing job satisfaction for employees in government entities.
Helping to provide better services to customers.
Developing the productive capacity of employees and improving daily performance by giving the employee the opportunity to complete their work at a time when their productivity is higher.
Having a positive impact on the family and thus the community.
Reducing the administrative burden on Human Resources departments in government entities (penalties and absences) and reducing the number of attendance and departure permits.

Duties of the Central Department

The Central Department shall supervise the implementation of the provisions of this guide and, in order to do so, shall undertake the following:

Preparing and developing the system and setting the necessary plans for its implementation.
Ensuring that Human Resources units carry out their duties as stipulated in this system.
Coordinating with the Finance Department to align the resource system with the guide.
Reviewing and re-evaluating the system annually or as needed, and submitting the results of these reviews and suggestions to the Ruler's Representative for approval.

System Mechanism

The flexible working hours system operates as follows:

The working time of employees within the government entity is divided into different periods for arrival and departure. The official working hours, which start from 7:30 AM to 2:30 PM, are considered the core hours, and any other times are considered flexible official working hours as shown below, provided that the employee completes seven consecutive working hours from their actual arrival time:
1. Employee entry time: from 7:00 AM - 8:30 AM
2. Employee exit time: from 2:00 PM - 3:30 PM.
The official working hours during the month of Ramadan start from 09:00 AM to 02:00 PM, and any other times are considered flexible official working hours as shown below, provided that the employee completes five consecutive working hours from their actual arrival time:
1. Employee entry time: from 8:00 AM - 10:00 AM
2. Employee exit time: from 1:00 PM - 3:00 PM.
Customer service employees must adhere to the official working hours from 07:30 AM to 02:30 PM, unless the government entity deems it possible for its employees in the customer service department or any position related to the public to benefit from the flexible working hours system, without prejudice to the proper conduct of work in the government entity.

1	Director General	Approving the internal regulations and decisions necessary for implementing the flexible working hours system in the department, in a way that does not conflict with this system.
2	Department Manager	Supervising the correct implementation of the flexible working hours system.
3	Employee's Direct Supervisor	Coordinating with employees to implement the flexible working hours system in a manner that suits the nature of the department's work and does not disrupt the workflow.
4	Human Resources Unit	Reorganizing work with the new working hours for employees. Measuring the effectiveness of the system in the department in coordination with the Central Department. Informing employees about the flexible system and its implementation mechanism. Answering any employee inquiries about the system.
5	Employee	Obtaining prior approval from the direct supervisor regarding the choice of suitable flexible working hours. Being able to meet the requirements and burdens of the job. Using official work time effectively. Adhering to the use of the attendance and departure system.

Personal Leave

Every employee may take personal leave with an excuse, not exceeding a maximum of 3 hours once a day, with a minimum personal leave duration of 30 minutes. If it exceeds 3 hours, one day will be deducted from the employee's basic salary. It is not considered an acquired right for the employee and is used in necessary cases after obtaining the necessary approvals.
Personal leave hours may not exceed 7 hours in a single month.
Penalties for lateness and absence will be applied as stated in Article 17 of the Executive Regulations if the employee is late from the start of core working hours or flexible official working hours without an acceptable excuse.

Study Leave

An employee may be granted a short study break of up to two hours daily to attend classes in an accredited study program until the end of that program. The permission period for using the study leave starts from 12:30 PM, and the employee must attend a minimum of five official working hours before leaving the department. It is also permissible to combine study leave with personal leave, provided that it does not exceed 3 working hours.

Nursing Hour

After the end of maternity leave, a female employee is granted a period of one hour per day to nurse her newborn for a full year after the date of the end of the maternity leave. This period may be extended for a maximum of three months with a written recommendation from an accredited hospital. The said hour is counted within the working hours with full gross salary.

Measuring the Impact of System Implementation

The Human Resources unit in the concerned department, in coordination with the relevant departments where the system is applied, will conduct periodic reviews to evaluate the quality of the system's implementation, provide feedback and suggestions for its development, and ascertain the level of employee satisfaction. The necessary reports will be submitted to the Central Department.

General Guidelines

For the success of the system in government departments, the following guidelines must be followed:

Heads of organizational units should organize employee choices in a way that does not affect the workflow of the government entity.
All government entities must commit to using the electronic system approved by the Ajman government to manage the attendance and departure of employees during official working hours.
The competent authority may exempt certain categories whose job nature requires their presence at the workplace at the beginning of the official working day so that the services provided by offices and departments in government entities are not affected by this application.
The government entity may set internal instructions for working with the flexible hours system, provided that they do not exceed the general framework of this guide.
Organizational units in the government entity must coordinate with the Human Resources unit regarding the selection of appropriate times for employees after obtaining the necessary approvals.
All employees must complete their daily working hours.
Employees who work overtime are entitled to compensation for the additional hours they are assigned by the government entity, in accordance with the terms and conditions specified in the Civil Service Law and its executive regulations.
The Human Resources unit must establish a specific mechanism to publicize the system, raise awareness among employees about its objectives, and define how the system works and the intended goals to be achieved, so that the applied behavioral patterns and procedures become fixed and ingrained in the work environment culture.
Violations of flexible working hours are considered part of official working hours violations, and the violations and penalties stipulated in the Civil Service Law and its Executive Regulations will be applied.
The Human Resources unit will measure the application of the flexible working hours system through job satisfaction rates with the system and the extent of employees' adherence to official working hours.
An employee may take personal leave or study leave during the month of Ramadan based on the procedures approved in this guide.
A female employee is granted a nursing hour during official working hours in Ramadan.
