القرار الأميري رقم (5) لسنة 2015
بشأن تفويض صلاحية الإعفاء من الرسوم والغرامات المحلية
نحن حميد بن راشد النعيمي، عضو المجلس الأعلى حاكم إمارة عجمان.
بعد الإطلاع على احكام المادة (24(1) من المرسوم الاميري رقم (11) لسنة 2011 بشأن إصدار القانون المالي لحكومة عجمان، وعلى المرسوم الاميري رقم (4) لسنة 2014 بشأن إعادة تنظيم المجلس التنفيذي في إمارة عجمان
ولما إرتأينا فيه تحقيق المصلحة العامة ... فقد أصدرنا القرار الأميري الاتي نصه :
المادة(1)
اسم القرار وبدء العمل به
يسمى هذا القرار» القرار الأميري رقم (5) لسنة 2015 بشأن تفويض صلاحية الإعفاء من الرسوم والغرامات المحلية ويعمل به إعتباراً من تاریخ صدوره.
المادة (2)
تفويض
يفوض سمو الشيخ عمار بن حميد النعيمي ولي عهد عجمان، رئیس المجلس التنفيذي بصلاحية الإعفاء من الرسوم والغرامات المحلية المطبقة لدى كافة الدوائر والهيئات والمؤسسات والإدارات التابعة الحكومة عجمان. وفي حال غياب حاكم الإمارة وولي عهد الإمارة، يمارس تلك الصلاحية سمو الشيخ أحمد بن حميد النعيمي، ممثل الحاكم للشؤون الإدارية والمالية.
المادة (3)
إلغاء التشريعات السابقة
يلغى كل حكم أو نص ورد في أي تشريع محلي ساري المفعول في الامارة ، في وقت نفاذ هذا القرار، إذا كان مخالفاً لأحكام هذا القرار ، بقدر ما قد يكون لازماً لإزالة المخالفة.
المادة (4)
نشر القرار وتعميمه
ينشر هذا القرار الأميري في الجريدة الرسمية للإمارة، ويعمم على كافة الجهات المعنية بتنفيذه للعمل بمقتضاه كل فيما يخصه.
صدر عنا بتوقيعنا عليه وختمه بخاتم الإمارة في مكتبنا بالديوان الأميري بعجمان في هذا اليوم الأربعاء الموافق التاسع والعشرون من شهر ربيع الآخر سنة 1436 هجرية، الموافق الثامن عشر من شهر فبراير سنة 2015 ميلادية.

Concerning the Delegation of Authority to Exempt from Local Fees and Fines
We, Humaid bin Rashid Al Nuaimi, Member of the Supreme Council, Ruler of the Emirate of Ajman.
Having reviewed the provisions of Article (24)(1) of Amiri Decree No. (11) of 2011 regarding the issuance of the Financial Law of the Government of Ajman, and Amiri Decree No. (4) of 2014 concerning the reorganization of the Executive Council in the Emirate of Ajman,
And for the purpose of achieving the public interest... We have issued the following Amiri Decree:
Article (1)
Name of the Decree and its Commencement
This Decree shall be named "Amiri Decree No. (5) of 2015 concerning the Delegation of Authority to Exempt from Local Fees and Fines" and shall come into effect from the date of its issuance.
Article (2)
Delegation
His Highness Sheikh Ammar bin Humaid Al Nuaimi, Crown Prince of Ajman and Chairman of the Executive Council, is hereby delegated the authority to grant exemptions from local fees and fines applicable to all departments, authorities, institutions, and administrations affiliated with the Government of Ajman. In the absence of the Ruler of the Emirate and the Crown Prince, this authority shall be exercised by His Highness Sheikh Ahmed bin Humaid Al Nuaimi, the Ruler's Representative for Administrative and Financial Affairs.
Article (3)
Repeal of Previous Legislation
Any provision or text in any local legislation in force in the Emirate at the time of this Decree's enforcement that contradicts the provisions of this Decree shall be repealed to the extent necessary to remove the contradiction.
Article (4)
Publication and Circulation of the Decree
This Amiri Decree shall be published in the Official Gazette of the Emirate and circulated to all concerned authorities for its implementation, each within its own jurisdiction.
Issued by us with our signature and sealed with the seal of the Emirate at our office in the Amiri Diwan in Ajman on this day, Wednesday, the twenty-ninth of Rabi' Al-Akhir, 1436 Hijri, corresponding to the eighteenth of February, 2015 Gregorian.
