فرض رسم درهم الابتكار

بعد الاطلاع على القانون رقم (4) لسنة 2005 بشأن فرض رسم درهم المعرفة وتعديلاته،
وعلى القانون رقم (19) لسنة 2015 بإنشاء متحف المستقبل،
وعلى قرار المجلس التنفيذي رقم (10) لسنة 2006 بشأن اللائحة التنفيذية لقانون رسم درهم المعرفة،
نُصدر القانون التالي:
التسمية
المادة (1)
يُسمى هذا القانون "قانون فرض رسم درهم الابتكار رقم (20) لسنة 2015".
التعريفات
المادة (2)
تكون للكلمات والعبارات التالية، حيثما وردت في هذا القانون، المعاني المبينة إزاء كل منها، ما لم يدل سياق النص على غير ذلك:

| الحكومة |
: حكومة دبي. |
| المؤسسة |
: مؤسسة دبي لمتحف المستقبل. |
| المجلس |
: مجلس أمناء المؤسسة. |
| الرئيس |
: رئيس المجلس. |
| الجهات الحكومية |
: الدوائر الحكومية والهيئات والمؤسسات العامة، وتشمل سلطات المناطق الحرة والمجالس الحكومية، التي يصدر بتحديدها قرار من الرئيس. |
| المعاملة |
: وتشمل أية خدمة أو معاملة أو نشاط تتم لدى الجهة الحكومية أو من قبلها ويُستوفى عنها رسم تُحدده التشريعات السارية في الإمارة، ويُعتبر في حكم المعاملة لغايات هذا القانون كل مخالفة تفرض على مرتكبها في الإمارة غرامة من قبل الجهة الحكومية تحددها التشريعات السارية في الإمارة. |
| درهم الابتكار |
: الرسم الذي يتم استيفاؤه وفقاً لأحكام هذا القانون والقرارات الصادرة بموجبه عن كل معاملة. |
| درهم المعرفة |
: الرسم المفروض بموجب القانون رقم (4) لسنة 2005 المشار إليه. |
نطاق التطبيق
المادة (3)
أ- تُطبّق أحكام هذا القانون على أي معاملة تتم لدى الجهات الحكومية.
ب- لا يستوفى درهم الابتكار عن أي معاملة يقل رسمها الأصلي أو الغرامة المترتبة عليها عن المبلغ الذي تحدده اللائحة التنفيذية لهذا القانون.
استيفاء درهم الابتكار
المادة (4)
تستوفي الجهات الحكومية عن كل معاملة، بالإضافة إلى درهم المعرفة، رسماً يُسمّى "درهم الابتكار" يتحدد مقداره بـ (10) عشرة دراهم.
إيداع درهم الابتكار
المادة (5)
يودع درهم الابتكار الذي يتم تحصيله بموجب هذا القانون في حساب خاص لدى أحد البنوك المحلية باسم المؤسسة، ويتم تخصيص حصيلته لدعم المؤسسة والمشاريع التي يصدر بتحديدها قرار من الرئيس.
تشكيل لجنة الاستثمار
المادة (6)
تُشكل في المؤسسة بقرار من الرئيس لجنة تُسمّى "لجنة استثمار درهم الابتكار" تتولى تحديد أوجه استثمار وتنمية درهم الابتكار، واقتراح تخصيص درهم الابتكار لدعم المشاريع المتعلقة بالابتكار، وعرضها على المجلس لاعتمادها.
مهام مجلس الأمناء
المادة (7)
يضع المجلس اللوائح والسياسات والمعايير الخاصة بالمشاريع المتعلقة بالابتكار ويتم اعتمادها من الرئيس تمهيداً لتعميمها على الجهات الحكومية في الإمارة.
السحب والصرف من الحساب المصرفي
المادة (8)
يكون للرئيس أو من يُفوّضه القيام بعمليات السحب والصرف والتحويل من الحساب المصرفي الخاص بدرهم الابتكار، وفقاً للائحة الصلاحيات المالية المعتمدة في المؤسسة.
إصدار القرارات التنفيذية
المادة (9)
يُصدر الرئيس أو من يُفوّضه اللائحة التنفيذية والقرارات اللازمة لتنفيذ أحكام هذا القانون.
الإلغاءات
المادة (10)
يُلغى أي نص في أي تشريع آخر إلى المدى الذي يتعارض فيه وأحكام هذا القانون.
النشر والسريان
المادة (11)
يُنشر هذا القانون في الجريدة الرسمية، ويُعمل به من تاريخ نشره.

Having reviewed Law No. (4) of 2005 Concerning the Imposition of the Knowledge Dirham Fee and its amendments,
And Law No. (19) of 2015 Establishing the Museum of the Future,
And Executive Council Resolution No. (10) of 2006 Concerning the Executive Regulation of the Knowledge Dirham Fee Law,
Do hereby issue the following Law:
Title
Article (1)
This Law shall be cited as the "Innovation Dirham Fee Imposition Law No. (20) of 2015".
Definitions
Article (2)
The following words and expressions shall, wherever mentioned in this Law, have the meanings indicated opposite each of them, unless the context implies otherwise:

: The Emirate of Dubai. |
| Government |
: The Government of Dubai. |
| Foundation |
: The Dubai Museum of the Future Foundation. |
| Board |
: The Board of Trustees of the Foundation. |
| Chairman |
: The Chairman of the Board. |
| Government Entities |
: Government departments, public authorities, and public corporations, including free zone authorities and government councils, as determined by a resolution of the Chairman. |
| Transaction |
: Includes any service, transaction, or activity conducted with or by a Government Entity, for which a fee is charged as prescribed by the legislation in force in the Emirate. For the purposes of this Law, any violation for which a fine is imposed on the perpetrator in the Emirate by a Government Entity, as prescribed by the legislation in force in the Emirate, shall be deemed a Transaction. |
| Innovation Dirham |
: The fee collected for each Transaction in accordance with the provisions of this Law and the resolutions issued pursuant thereto. |
| Knowledge Dirham |
: The fee imposed under the aforementioned Law No. (4) of 2005. |
Scope of Application
Article (3)
a- The provisions of this Law shall apply to any Transaction conducted with Government Entities.
b- The Innovation Dirham shall not be collected for any Transaction whose original fee or resulting fine is less than the amount specified in the Executive Regulation of this Law.
Collection of the Innovation Dirham
Article (4)
Government Entities shall collect, for each Transaction, in addition to the Knowledge Dirham, a fee named the "Innovation Dirham" in the amount of (10) ten dirhams.
Deposit of the Innovation Dirham
Article (5)
The Innovation Dirham collected under this Law shall be deposited into a special account in the name of the Foundation at a local bank. Its proceeds shall be allocated to support the Foundation and projects determined by a resolution of the Chairman.
Formation of the Investment Committee
Article (6)
A committee named the "Innovation Dirham Investment Committee" shall be formed within the Foundation by a resolution of the Chairman. This committee will be responsible for determining the means of investing and developing the Innovation Dirham, proposing the allocation of the Innovation Dirham to support innovation-related projects, and presenting them to the Board for approval.
Duties of the Board of Trustees
Article (7)
The Board shall establish the regulations, policies, and standards for innovation-related projects, which shall be approved by the Chairman before being circulated to the Government Entities in the Emirate.
Withdrawal and Disbursement from the Bank Account
Article (8)
The Chairman, or his authorized representative, shall be responsible for withdrawal, disbursement, and transfer operations from the special bank account of the Innovation Dirham, in accordance with the financial authorization regulations approved by the Foundation.
Issuance of Executive Resolutions
Article (9)
The Chairman, or his authorized representative, shall issue the Executive Regulation and resolutions necessary for the implementation of the provisions of this Law.
Repeals
Article (10)
Any provision in any other legislation shall be repealed to the extent that it contradicts the provisions of this Law.
Publication and Commencement
Article (11)
This Law shall be published in the Official Gazette and shall come into force from the date of its publication.
