بتعديل بعض أحكام القانون رقم (14) لسنة 2009
بشأن
تسعير الخدمات الحكومية في إمارة دبي
نحن محمد بن راشد آل مكتوم حاكم دبي
بعد الاطلاع على القانون رقم (14) لسنة 2009 بشأن تسعير الخدمات الحكومية في إمارة دبي، ويُشار إليه فيما بعد بـ "القانون الأصلي"،
نصدر القانون التالي:
المادة (1)
يُستبدل بنصوص المواد (2)، (7) ، (9) من القانون الأصلي، النصوص التالية:
المادة (2)
تكون للكلمات والعبارات التالية، حيثما وردت في هذا القانون، المعاني المبينة إزاء كل منها، ما لم يدل سياق النص على غير ذلك:

| الحكومة: |
حكومة دبي. |
| المجلس التنفيذي: |
المجلس التنفيذي للإمارة. |
| الدائرة: |
دائرة المالية. |
| الجهات الحكومية: |
الدوائر والهيئات والمؤسسات العامة والسلطات والمجالس الحكومية وأية جهة حكومية أخرى تابعة للحكومة. |
| الرسم: |
مورد مالي يتم تحصيله من قبل الجهة الحكومية نظير الخدمات العامة التي تنفرد بتقديمها للأفراد والشركات والمؤسسات وغيرها من الجهات. |
| الثمن: |
مورد مالي يتم تحصيله من قبل الجهة الحكومية نظير السلع والخدمات التي تقدمها للأفراد والشركات والمؤسسات وغيرها من الجهات على أسس تجارية وتنافسية. |
| التعرفة: |
مورد مالي يتم تحصيله من قبل الجهة الحكومية نظير السلع والخدمات الاقتصادية غير التنافسية التي تنفرد بتقديمها للأفراد والشركات والمؤسسات وغيرها من الجهات. |
المادة (7)
أ- تتولى الدائرة، وبالاستناد إلى الضوابط والمعايير المنصوص عليها في الدليل المشار إليه في المادة (5) من هذا القانون، القيام بما يلي:
1- مراجعة كافة الرسوم والأثمان والتعرفات المفروضة على الخدمات المقدمة من الجهات الحكومية قبل العمل بأحكام هذا القانون لقياس مدى تجاوز قيمها للحدود المفترضة من عدمه.
2- دراسة وإقرار طلبات الجهات الحكومية باستحداث أو تعديل أية رسوم على أية خدمات مقدمة من قبلها، ورفع التوصيات المناسبة بشأنها إلى المجلس التنفيذي لاعتمادها.
3- دراسة واعتماد طلبات الجهات الحكومية باستحداث أو تعديل أية أثمان أو تعرفات تقرّرها على أية سلع أو خدمات مقدمة من قبلها.
4- دراسة وإقرار وسائل الدفع الحديثة للرسوم والأثمان والتعرفات، وكذلك التسهيلات المناسبة لسدادها من المكلّفين بها، وذلك بالتنسيق مع الجهات الحكومية.
المادة (9)
يُصدر رئيس المجلس التنفيذي القرارات اللازمة لتنفيذ أحكام هذا القانون، بما في ذلك اعتماد قوائم تخفيض الرسوم على الخدمات الحكومية.
المادة (2)
يُعمل بهذا القانون من تاريخ صدوره، ويُنشر في الجريدة الرسمية.

Amending certain provisions of Law No. (14) of 2009
Concerning
The Pricing of Government Services in the Emirate of Dubai
We, Mohammed bin Rashid Al Maktoum, Ruler of Dubai
After perusing Law No. (14) of 2009 concerning the Pricing of Government Services in the Emirate of Dubai, hereinafter referred to as the "Original Law",
Do hereby issue the following Law:
Article (1)
The texts of Articles (2), (7), and (9) of the Original Law are hereby replaced by the following texts:
Article (2)
The following words and expressions shall, wherever mentioned in this Law, have the meanings indicated opposite each of them, unless the context implies otherwise:
| The Emirate: |
The Emirate of Dubai. |
| The Government: |
The Government of Dubai. |
| The Executive Council: |
The Executive Council of the Emirate. |
| The Department: |
The Department of Finance. |
| Government Entities: |
Government departments, public authorities, public corporations, councils, and any other government entity affiliated with the Government. |
| Fee: |
A financial resource collected by a Government Entity in return for public services it exclusively provides to individuals, companies, establishments, and other entities. |
| Price: |
A financial resource collected by a Government Entity in return for goods and services it provides to individuals, companies, establishments, and other entities on commercial and competitive bases. |
| Tariff: |
A financial resource collected by a Government Entity in return for non-competitive economic goods and services it exclusively provides to individuals, companies, establishments, and other entities. |
Article (7)
a- The Department shall, based on the rules and criteria stipulated in the guide referred to in Article (5) of this Law, undertake the following:
1- Reviewing all fees, prices, and tariffs imposed on services provided by Government Entities before the enforcement of this Law to determine whether or not their values exceed the prescribed limits.
2- Studying and approving the requests of Government Entities to introduce or amend any fees for any services they provide, and submitting appropriate recommendations thereon to the Executive Council for approval.
3- Studying and approving the requests of Government Entities to introduce or amend any prices or tariffs they determine for any goods or services they provide.
4- Studying and approving modern payment methods for fees, prices, and tariffs, as well as appropriate payment facilities for those liable to pay them, in coordination with Government Entities.
Article (9)
The Chairman of the Executive Council shall issue the resolutions required for the implementation of the provisions of this Law, including the approval of lists for reducing fees for government services.
Article (2)
This Law shall come into force from the date of its issuance and shall be published in the Official Gazette.
