القانون رقم (35) لسنة 2009
بشأن إدارة الأموال العامة لحكومة دبي

بعد الاطلاع على القانون رقم (35) لسنة 2009 بشأن إدارة الأموال العامة لحكومة دبي،
نُصدر القانون التالي:
المادة (1)
يُستبدل بنص المادة (5) من القانون رقم (35) لسنة 2009 المشار إليه، النص التالي:
المادة (5)
أ- تعتبر الجهة الحكومية متمتعة بالاستقلال المالي وذات موازنة مستقلة إذا كان التشريع الذي أنشأها وطبيعة عملها تقضي بذلك، وعلى هذه الجهة الالتزام بما يلي:
1- رفع موازنتها السنوية إلى اللجنة العليا لاعتمادها، وذلك بعد أن تقوم اللجنة المذكورة بعرضها على الدائرة لإبداء الرأي فيها.
2- توفير كافة البيانات المتعلقة بموازنتها المعتمدة وحسابها الختامي في بداية ونهاية السنة المالية وتزويد الدائرة بها.
3- الأحكام المالية المنصوص عليها في أية تشريعات محلية سارية المفعول، ومنها أحكام الدين العام والاقتراض واعتماد وتحصيل الرسوم والضرائب والرقابة المالية وتقديم البيانات والتقارير المالية للجهات المعنية.
4- تحويل فائض إيراداتها السنوية إلى مؤسسة دبي للاستثمارات الحكومية.
ب- لا يجوز منح الجهة الحكومية المتمتعة بالاستقلال المالي وفقاً لأحكام الفقرة (أ) من هذه المادة أية اعتمادات أو مخصصات من الموازنة العامة إلا على شكل قروض، ويستثنى من ذلك الجهات التي تقرر اللجنة العليا، بناء على توصية مدير عام الدائرة، منحها تلك الاعتمادات أو المخصصات على شكل دعم مالي من الحكومة، ويتم منح هذا الدعم وفقاً للضوابط والشروط والمدد التي تحددها اللجنة العليا في هذا الشأن.
المادة (2)
يُعمل بهذا القانون من تاريخ صدوره، ويُنشر في الجريدة الرسمية.

Amending
Law No. (35) of 2009
Concerning the Management of Public Funds of the Government of Dubai
We, Mohammed bin Rashid Al Maktoum, Ruler of Dubai
After perusing Law No. (35) of 2009 Concerning the Management of Public Funds of the Government of Dubai,
Do hereby issue the following Law:
Article (1)
The text of Article (5) of the aforementioned Law No. (35) of 2009 is hereby replaced by the following text:
Article (5)
A- A Government Entity will be deemed to have financial independence and an independent budget if its establishing legislation and the nature of its work so require. Such an entity must comply with the following:
1- Submitting its annual budget to the Supreme Committee for approval, after the said committee presents it to the Department for its opinion.
2- Providing all data related to its approved budget and its final account at the beginning and end of the fiscal year and supplying the Department with the same.
3- The financial provisions stipulated in any effective local legislation, including provisions on public debt, borrowing, approval and collection of fees and taxes, financial supervision, and submission of financial data and reports to the concerned authorities.
4- Transferring its annual surplus revenue to the Investment Corporation of Dubai.
B- A Government Entity enjoying financial independence in accordance with the provisions of paragraph (A) of this Article may not be granted any appropriations or allocations from the General Budget except in the form of loans. This excludes entities that the Supreme Committee, based on the recommendation of the Director General of the Department, decides to grant such appropriations or allocations in the form of financial support from the Government. This support will be granted in accordance with the rules, conditions, and periods determined by the Supreme Committee in this regard.
Article (2)
This Law comes into force on the date of its issuance and will be published in the Official Gazette.
