Decree No. (1) of 2015
Concerning
The Sewerage Fee in the Emirate of Dubai
We, Mohammed bin Rashid Al Maktoum, Ruler of Dubai
After perusing Law No. (3) of 2003 Concerning the Establishment of an Executive Council for the Emirate of Dubai,
And Law No. (16) of 2007 Concerning the Establishment of the Real Estate Regulatory Agency,
And Law No. (14) of 2009 Concerning the Pricing of Government Services in the Emirate of Dubai and its amendments,
And Law No. (35) of 2009 Concerning the Management of Public Funds of the Government of Dubai and its amendments,
And Decree No. (1) of 1992 Concerning the Establishment of the Dubai Electricity and Water Authority and its amendments,
And Decree No. (22) of 2009 Concerning Special Development Zones in the Emirate of Dubai,
And the Order Establishing Dubai Municipality of 1961,
And the Order issued on 09/12/1995 Concerning the Imposition of a Fee for Sewerage Operations in the Emirate of Dubai,
And Local Order No. (8) of 2002 Concerning Sewerage, Irrigation, and Water Drainage in the Emirate of Dubai,
And the legislation regulating free zones in the Emirate of Dubai,
Do hereby issue the following Decree:
Definitions
Article (1)
The following words and expressions shall, wherever mentioned in this Decree, have the meanings indicated opposite each of them, unless the context implies otherwise:
| The Emirate: | The Emirate of Dubai. |
| The Executive Council: | The Executive Council of the Emirate. |
| The Municipality: | Dubai Municipality. |
| The Authority: | Dubai Electricity and Water Authority. |
| The Real Estate Unit: | Any owned or leased property, including warehouses, factories, workshops, and the like, connected to the Authority's water network or the Municipality's public sewerage network, or both. |
| The Occupant: | The natural or legal person who occupies the Real Estate Unit, whether for residential purposes or for conducting any economic activity, and includes the owner, lessee, and usufructuary. |
| The Sewerage Fee: | The fee prescribed under this Decree on the Occupant of the Real Estate Unit in return for the Sewerage Operations provided in the Emirate. |
| Sewerage Operations: | The operations related to planning, designing, controlling, and supervising sewerage in the Emirate, which include, without limitation, implementing sewerage networks, establishing treatment plants, establishing septic tanks and soakaways, determining the connection points of private sewerage networks to the public sewerage network and their connection operations, using treated water and the solid waste generated from it (sludge), inspecting sewerage systems and treatment plants to verify their specifications and efficiency, protecting sewerage systems and preventing any activities or constructions that may negatively affect their operational efficiency, and taking necessary measures to address any defect in these systems that may affect public health, safety, and the environment. |
| The Service Provider: | Any public or private entity authorized to establish or manage a private sewerage network in any area of the Emirate. |
Scope of Application
Article (2)
The provisions of this Decree shall apply to all Real Estate Units in the Emirate, including special development zones and free zones, including the Dubai International Financial Centre, with the exception of residential Real Estate Units occupied by citizens of the United Arab Emirates.
Parties Liable for the Fee and its Amount
Article (3)
A fee shall be collected from the Occupants of Real Estate Units in return for the Sewerage Operations provided by the Municipality in the Emirate, the amount of which shall be determined as follows:
1- One fils for each gallon of water consumed by Real Estate Units connected to the public sewerage network.
2- One fils for each gallon of water consumed by Real Estate Units connected to a private sewerage network operated and supervised by the Municipality.
3- Half a fils for each gallon of water consumed by Real Estate Units connected to a private sewerage network operated and supervised by a party other than the Municipality.
Assessment of the Sewerage Fee
Article (4)
For the purposes of collecting the Sewerage Fee, the Municipality, in coordination with the concerned entities, shall undertake the following:
1- Verifying the amount of water consumption of Real Estate Units.
2- Assessing the value of the Sewerage Fee for Real Estate Units connected to the public sewerage network but not connected to the Authority's water network.
3- Assessing the value of the Sewerage Fee for Real Estate Units for which incorrect information or data is provided.
Rights of the Service Provider
Article (5)
This Decree shall not prejudice the right of the Service Provider to impose any financial costs on the Occupants of Real Estate Units not connected to the Municipality's public sewerage network in return for the sewerage services it provides to them, provided that these costs are approved by the Real Estate Regulatory Agency.
Fee Collection Mechanism
Article (6)
The Sewerage Fee shall be collected through the Authority or any other entity in the manner, method, and at the times specified by the Municipality.
Devolution of the Fee
Article (7)
The proceeds of the Sewerage Fee collected under this Decree shall be transferred to the Public Treasury account of the Government of Dubai.
Issuance of Implementing Resolutions
Article (8)
The Chairman of the Executive Council shall issue the necessary resolutions to implement the provisions of this Decree.
Repeals
Article (9)
a- This Decree shall replace the Order issued on 09/12/1995 Concerning the Imposition of a Fee for Sewerage Operations in the Emirate of Dubai.
b- Any provision in any other legislation shall be repealed to the extent that it contradicts the provisions of this Decree.
Publication and Entry into Force
Article (10)
This Decree shall be published in the Official Gazette, and shall come into force as of the first of March 2015.
