بعد الاطلاع على قانون غرفة تجارة وصناعة دبي لسنة ١٩٧٥ وتعديلاته.

وبناء على ما قرره مجلس ادارة غرفة تجارة وصناعة دبي في اجتماعه الرابع بتاريخ ٨ / ٥ / ١٩٩٤.

نرسم ما يلي:

تستوفي غرفة تجارة وصناعة دبي رسوم العضوية فيها ورسوم اصدار الشهادات والتصديقات وغيرها من الخدمات المناطة بها وفقاً للجداول ذوات الأرقام (١) و (٢) و (٣) الملحقة بهذا المرسوم.

( أ ) اذا كانت المنشأة تزاول عدة أنشطة اقتصادية غير متجانسة وذات فئات مختلفة، أو كانت تخضع من حيث الشكل القانوني أو جنسية الشركاء لأكثر من فئة، فيستوفى منها الرسم على أساس أعلى فئة تندرج تحتها وفقاً للجدول رقم (١).

(ب) أما اذا زاولت المنشأة نشاطها الاقتصادي في فرع أو أكثر بالاضافة الى مركزها الرئيسي فيستوفى رسم العضوية عن كل فرع آخر لها بنفس مقدار الرسم المقرر على مركزها الرئيسي.

تقوم الهيئة التنفيذية لمجلس الغرفة بتصنيف أية منشأة لا يوجد لها في الجدول رقم (١) فئة تلحق بها بشكل مباشر، وذلك بتصنيفها تحت أقرب الفئات المماثلة لها.

( أ ) يستوفى رسم العضوية عن سنة كاملة، ولا يجوز استرداد أي جزء منه ولو توقفت المنشأة عن مزاولة نشاطها.

(ب) يجوز للمنشأة أن تسدد رسم العضوية لأكثر من سنة دفعة واحدة، ولها في حال الغاء عضويتها لأي سبب، أن تسترد الرسم المستوفى عن السنوات المتبقية من مدة العضوية وذلك باستثناء رسم السنة التي يتم فيها الالغاء.

(جـ) يعتبر رسم العضوية المستوفى مقدماً لأكثر من سنة قبل نفاذ أحكام هذا المرسوم مسدداً عن كامل المدة المدفوع عنها الرسم، ولا تطالب المنشأة بفرق الرسم المقرر وفقاً لأحكام هذا المرسوم عن المدة المذكورة.

تسري بشأن المنشآت التي لم تسدد رسم العضوية عن السنوات السابقة لتاريخ نفاذ هذا المرسوم، أحكام المرسوم رقم (١) لسنة ١٩٨٣.

مع مراعاة أحكام المادة (٥) يلغى المرسوم رقم (١) لسنة ١٩٨٣ وأي نص في أي مرسوم آخر الى المدى الذي يتعارض فيه وأحكام هذا المرسوم.

يُنشر هذا المرسوم في الجريدة الرسمية، ويُعمل به من تاريخ نشره.

We, Maktoum bin Rashid Al Maktoum, Ruler of Dubai

Having reviewed the Law of the Dubai Chamber of Commerce and Industry of 1975 and its amendments.

And based on the decision of the Board of Directors of the Dubai Chamber of Commerce and Industry in its fourth meeting on 08/05/1994.

Hereby decree the following:

The Dubai Chamber of Commerce and Industry shall collect its membership fees and fees for the issuance of certificates, attestations, and other services entrusted to it, in accordance with Schedules No. (1), (2), and (3) attached to this decree.

(a) If an establishment engages in several non-homogeneous economic activities of different categories, or is subject to more than one category in terms of legal form or nationality of partners, the fee shall be collected based on the highest category under which it falls according to Schedule No. (1).

(b) If the establishment carries out its economic activity in one or more branches in addition to its head office, the membership fee for each additional branch shall be collected at the same amount as the fee prescribed for its head office.

The Executive Body of the Chamber's Board shall classify any establishment that does not have a directly applicable category in Schedule No. (1) by classifying it under the closest similar categories.

(a) The membership fee shall be collected for a full year, and no part of it may be refunded even if the establishment ceases its activities.

(b) An establishment may pay the membership fee for more than one year in a single payment. In the event of its membership being cancelled for any reason, it may refund the fee collected for the remaining years of the membership period, excluding the fee for the year in which the cancellation occurs.

(c) Membership fees collected in advance for more than one year before the enforcement of this decree shall be considered as paid for the entire period for which the fee was paid. The establishment shall not be required to pay the difference in fees prescribed under this decree for the said period.

For establishments that have not paid the membership fee for the years prior to the date this decree comes into force, the provisions of Decree No. (1) of 1983 shall apply.

Subject to the provisions of Article (5), Decree No. (1) of 1983 and any provision in any other decree that conflicts with the provisions of this decree are hereby repealed.

This decree shall be published in the Official Gazette and shall come into force from the date of its publication.
