بشأن المخالفات والغرامات الإدارية الخاصة بالمصارف الأجنبية العاملة في إمارة عجمان

نحن عمار بن حميد النعيمي ولي عهد إمارة عجمان

بعد الاطلاع على القانون رقم (3) لسنة 2024 بشأن الضريبة على المصارف الأجنبية العاملة في إمارة عجمان،
وعلى المرسوم الأميري رقم (11) لسنة 2011 بإصدار القانون المالي لحكومة عجمان، ولائحته التنفيذية،
وعلى المرسوم الأميري رقم (15) لسنة 2012 بشأن دائرة المالية في عجمان وتعديلاته،
وعلى المرسوم الأميري رقم (5) لسنة 2017 بشأن جهاز الرقابة المالية في عجمان،

وبناءً على موافقة لجنة التشريعات، أصدرنا القرار الآتي:

المادة (1) اعتماد المخالفات والغرامات الإدارية

أ. مع عدم الإخلال بأي عقوبة أشد ينص عليها أي تشريع آخر، تعتمد بموجب هذا القرار المخالفات والغرامات الإدارية الخاصة بالمصارف الأجنبية، وفقًا لما هو محدد في الجدول الملحق بهذا القرار.

ب. تضاعف قيمة الغرامة المحددة في الجدول الملحق بهذا القرار، في حال معاودة ارتكاب المخالفة الإدارية ذاتها خلال سنتين من تاريخ ارتكاب المخالفة الإدارية السابقة لها، وبما لا يزيد على (500.000) خمسمائة ألف درهم.

المادة (2) أيلولة الغرامات

تؤول حصيلة الغرامات التي يتم استيفاؤها بموجب أحكام هذا القرار لحساب الخزانة العامة لحكومة عجمان.

المادة (3) السريان والنشر

يعمل بهذا القرار من تاريخ صدوره وينشر في الجريدة الرسمية.

صدر عنا في هذا اليوم الثلاثاء الموافق 18 من شهر رمضان 1446 هجرية، الموافق 18 من شهر مارس سنة 2025 ميلادية.

1	عدم تزويد الدائرة بالإقرار الضريبي والنماذج الضريبية والمستندات المؤيدة له طبقًا لما هو معتمد من الدائرة وخلال المهلة المحددة من قبلها، أو عدم تزويد الجهاز بالقوائم والنماذج والمستندات والإيضاحات والبيانات والمعلومات التي يطلبها في المواعيد المحددة من قبله.	1.000 درهم عن كل يوم تأخير
2	تزويد الدائرة، أو الجهاز بأي قوائم أو نماذج، أو مستندات، أو إيضاحات، أو بيانات، أو معلومات بصورة غير صحيحة أو غير مطابقة للقواعد والإجراءات المقررة.	10.000 درهم عن كل نموذج أو مستند غير صحيح أو غير مطابق
3	التأخر عن تقديم التصريح الطوعي في حال ما إذا كان الإقرار الضريبي الذي قدمه الخاضع للضريبة أدى إلى احتساب الضريبة مستحقة الدفع بأقل مما يجب، أو تقديم ذلك التصريح وقت إجراء التدقيق الضريبي.	10% من مبلغ الفروقات الضريبية الناتجة عن عملية التدقيق، وبحد أقصى 250.000 درهم
4	التأخر عن تقديم التصريح الطوعي في حال ما إذا كان التقييم الضريبي المرسل إلى الخاضع للضريبة أقل من الضريبة مستحقة الدفع، أو ذلك التصريح وقت إجراء التدقيق الضريبي.	10% من مبلغ الفروقات الضريبية الناتجة عن عملية التدقيق، وبحد أقصى 250.000 درهم
5	عدم قيام الخاضع للضريبة بإخطار الدائرة والجهاز بأي تعديل على بيانات التسجيل الأساسية.	10.000 درهم
6	ارتكاب أي فعل يشكل مخالفة للقرارات والتعليمات والتوجيهات الصادرة إلى الخاضع للضريبة من الدائرة أو الجهاز.	5.000 درهم
7	عدم قيام الخاضع للضريبة بتقديم طلب التسجيل للدائرة خلال المهلة المحددة.	5.000 درهم
8	عدم قيام الخاضع للضريبة بتقديم طلب إلغاء التسجيل للدائرة خلال المهلة المحددة.	1.000 درهم، عن كل شهر تأخير، وبحد أقصى 10.000 درهم، ويعتبر جزء الشهر شهراً كاملاً

Concerning Administrative Violations and Fines for Foreign Banks Operating in the Emirate of Ajman

We, Ammar bin Humaid Al Nuaimi, Crown Prince of the Emirate of Ajman,

Having reviewed Law No. (3) of 2024 concerning the Tax on Foreign Banks Operating in the Emirate of Ajman,
And Emiri Decree No. (11) of 2011 issuing the Financial Law of the Government of Ajman, and its executive regulations,
And Emiri Decree No. (15) of 2012 concerning the Department of Finance in Ajman and its amendments,
And Emiri Decree No. (5) of 2017 concerning the Financial Audit Authority in Ajman,

And based on the approval of the Legislation Committee, We have issued the following Decision:

Article (1) Adoption of Administrative Violations and Fines

A. Without prejudice to any more severe penalty stipulated in any other legislation, the administrative violations and fines for foreign banks are hereby adopted under this Decision, as specified in the table attached to this Decision.

B. The value of the fine specified in the table attached to this Decision shall be doubled in the event of re-committing the same administrative violation within two years from the date of committing the previous administrative violation, provided that it does not exceed (500,000) five hundred thousand dirhams.

Article (2) Remittance of Fines

The proceeds of the fines collected under the provisions of this Decision shall be remitted to the public treasury account of the Government of Ajman.

Article (3) Entry into Force and Publication

This Decision shall come into force from the date of its issuance and shall be published in the Official Gazette.

Issued by us on this day, Tuesday, the 18th of Ramadan 1446 AH, corresponding to the 18th of March 2025 AD.

2	Providing the Department or the Authority with any lists, forms, documents, clarifications, data, or information that is incorrect or does not comply with the established rules and procedures.	10,000 Dirhams for each incorrect or non-compliant form or document
3	Delay in submitting a voluntary disclosure in case the tax return submitted by the Taxable Person resulted in the calculation of tax payable being less than it should be, or submitting such disclosure at the time of a tax audit.	10% of the amount of the tax differences resulting from the audit process, with a maximum of 250,000 Dirhams
4	Delay in submitting a voluntary disclosure in case the tax assessment sent to the Taxable Person is less than the tax payable, or submitting such disclosure at the time of a tax audit.	10% of the amount of the tax differences resulting from the audit process, with a maximum of 250,000 Dirhams
5	Failure of the Taxable Person to notify the Department and the Authority of any amendment to the basic registration data.	10,000 Dirhams
6	Committing any act that constitutes a violation of the decisions, instructions, and directives issued to the Taxable Person by the Department or the Authority.	5,000 Dirhams
7	Failure of the Taxable Person to submit a registration application to the Department within the specified deadline.	5,000 Dirhams
8	Failure of the Taxable Person to submit a de-registration application to the Department within the specified deadline.	1,000 Dirhams for each month of delay, with a maximum of 10,000 Dirhams. Part of a month is considered a full month.
