Emiri Decision No. (15) of 2020
Concerning
Service Fees and Fines Applied by the Ajman Transport Authority
We, Ammar bin Humaid Al Nuaimi, Crown Prince of the Emirate of Ajman,
Having reviewed Emiri Decree No. (11) of 2011 issuing the Financial Law of the Government of Ajman and its executive regulations,
And Emiri Decree No. (4) of 2014 concerning the reorganization of the Executive Council of the Emirate of Ajman and its amendments,
And Emiri Decree No. (1) of 2018 concerning the reorganization of the Ajman Public Transport Corporation and its amendments,
And Emiri Decree No. (2) of 2018 concerning the Legislation Committee in the Emirate of Ajman,
And Emiri Decree No. (1) of 2019 concerning Fees, Taxes, and Fines in the Emirate of Ajman,
And Emiri Decree No. (2) of 2020 concerning the transfer of the competencies of the Department of Civil Aviation in Ajman and its abolition,
And Emiri Decision No. (4) of 2015 issuing the regulation of service fees and fines applied by the Ajman Public Transport Corporation,
And based on the approval of the Legislation Committee,
We have issued the following Decision:
Article (1)
Adoption of Fees
The Ajman Transport Authority shall collect, in return for providing the services shown in Schedules (1) and (2) attached to this Decision, the fees specified for each.
Article (2)
Recording Violations, Imposing and Collecting Fines
a. The Ajman Transport Authority shall be responsible for recording and proving the violations stipulated in Schedules (3) and (4) attached to this Decision, imposing the fine, and collecting its value as indicated for each.
b. In addition to the fine stipulated in Schedules (3) and (4) attached to this Decision, the Director-General of the Ajman Transport Authority, or his authorized representative, may, in the event of a repeated violation, take any of the following measures against the violator:
1. Closing the violating establishment for a period not exceeding (30) days.
2. Canceling the initial approval or the permit issued by the Ajman Transport Authority.
3. Addressing the competent authority to cancel the license in accordance with its established procedures.
c. The initial approval or permit issued by the Ajman Transport Authority may not be renewed before all fines approved under this Decision are paid.
Article (3)
Grievance
A written grievance may be submitted to the Director-General of the Ajman Transport Authority, or his authorized representative, within (15) days from the date of notification of the violation, decision, action, or measure being grieved. This grievance shall be decided upon within (30) days from the date of its submission, by a committee formed by the Director-General for this purpose. The decision forming the committee shall specify its working mechanism.
Article (4)
Capacity of Judicial Enforcement Officers
The employees of the Ajman Transport Authority, who are designated by a decision from the Minister of Justice upon the request of the Director-General, shall have the capacity of judicial enforcement officers in proving acts committed in violation of the provisions of this Decision. These employees shall have the authority to issue the necessary violation reports.
Article (5)
Repeals
Emiri Decision No. (4) of 2015 issuing the regulation of service fees and fines applied by the Ajman Public Transport Corporation is hereby repealed, as is any text or provision in any other decision that contradicts or contravenes the provisions of this Decision.
Article (6)
Entry into Force and Publication
This Decision shall come into effect (30) days after the date of its issuance and shall be published in the Official Gazette.
Issued by us on this day, the 16th of Jumada al-Awwal 1442 AH, corresponding to the 31st of December 2020 AD.
