تعميم رقم (1) لسنة 2019
بشأن دفع مستحقات المقاولين والموردين
إلى كافة الجهات والشركات الحكومية في إمارة أبوظبي
السلام عليكم ورحمة الله وبركاته،،،
نهديكم أطيب التحيات ونتقدم لكم بخالص الشكر والتقدير لتعاونكم الدائم لتحقيق المصلحة العامة.
لاحقاً لما ورد في التعميم رقم (4) لسنة 2017 بشأن مستحقات شركات القطاع الخاص، وانطلاقاً من الحرص الدائم على تشجيع القطاع الخاص ودفع مستحقاته المالية، فأنه يجب الالتزام بالآتي:
- دفع كافة مستحقات المقاولين والموردين خلال 30 يوم من تاريخ استلام الفواتير ذات العلاقة.
- إدراج بند في عقودها مع المقاولين والموردين ينص على التزام المقاولين والموردين بدفع مستحقات مقاولي وموردي الباطن خلال 30 يوم من تاريخ استلام مستحقاتهم من الجهات والشركات الحكومية.
- تعديل كافة العقود السارية مع المقاولين والموردين وفق ما ورد أعلاه.
- في حال وجود خلاف بين الطرفين على جزء من المبالغ المستحقة يتم دفع المبلغ غير المتنازع فيه، ولا يعتبر ذلك اسقاطاً لحق أي من الطرفين لحين الاتفاق على المبلغ المتبقي وفق العقد.

Regarding the Payment of Dues to Contractors and Suppliers
To all government entities and companies in the Emirate of Abu Dhabi
Peace, mercy, and blessings of God be upon you,,,
We extend our best regards and express our sincere thanks and appreciation for your continuous cooperation in achieving the public interest.
Further to Circular No. (4) for the year 2017 regarding the dues of private sector companies, and out of a constant keenness to encourage the private sector and pay its financial dues, the following must be adhered to:
- Payment of all dues to contractors and suppliers within 30 days from the date of receipt of the relevant invoices.
- Inclusion of a clause in their contracts with contractors and suppliers stipulating the commitment of contractors and suppliers to pay the dues of subcontractors and sub-suppliers within 30 days from the date of receiving their dues from government entities and companies.
- Amendment of all existing contracts with contractors and suppliers in accordance with the above.
- In the event of a dispute between the two parties over a portion of the amounts due, the undisputed amount shall be paid, and this shall not be considered a waiver of the rights of either party until an agreement is reached on the remaining amount according to the contract.
