مرسوم بقانون اتحادي رقم (27) لسنة 2022
بتعديل بعض أحكام المرسوم بقانون اتحادي رقم (9) لسنة 2018
في شأن الدين العام
نحن محمد بن زايد آل نهيان
رئيس دولة الإمارات العربية المتحدة،
بعد الاطلاع على الدستور،
وعلى القانون الاتحادي رقم (1) لسنة 1972 بشأن اختصاصات الوزارات وصلاحيات الوزراء، وتعديلاته،
وعلى المرسوم بقانون اتحادي رقم (9) لسنة 2018 في شأن الدين العام،
وعلى المرسوم بقانون اتحادي رقم (26) لسنة 2019 في شأن المالية العامة،
وبناءً على ما عرضه وزير المالية، وموافقة مجلس الوزراء،
أصدرنا المرسوم بقانون الآتي:
المادة الأولى
يُستبدل بنص المادة (11) من المرسوم بقانون اتحادي رقم (9) لسنة 2018 في شأن الدين العام، النص الآتي:
المادة (11)
الضمانات المالية الحكومية
1. مع عدم الإخلال بنص المادة (6) من هذا المرسوم بقانون، يجوز للحكومة تقديم ضمان مالي حكومي أو أكثر نيابة عن إحدى الجهات الحكومية بناءً على توصية من الوزير وموافقة مجلس الوزراء.
2. يصدر مجلس الوزراء بناءً على عرض الوزير قرارًا بتحديد الشروط والأحكام التي تنظم عملية إصدار الضمان المالي الحكومي.
3. يخول الوزير بمقتضى هذا المرسوم بقانون إصدار الضمان المالي الحكومي المطلوب تنفيذا لقرار مجلس الوزراء المنصوص عليها في البند (1) من هذه المادة.
4. يخطر الوزير المجلس الوطني الاتحادي بالضمانات التي قدمتها الحكومة تنفيذا لأحكام هذه المادة خلال (30) ثلاثين يوما على الأكثر من تاريخ تقديمها.
المادة الثانية
يُنشر هذا المرسوم بقانون في الجريدة الرسمية، ويُعمل به من تاريخ صدوره.

Amending certain provisions of Federal Decree-Law No. (9) of 2018
On Public Debt
We, Mohamed bin Zayed Al Nahyan
President of the United Arab Emirates,
Having reviewed the Constitution,
And Federal Law No. (1) of 1972 concerning the competencies of Ministries and the powers of Ministers, and its amendments,
And Federal Decree-Law No. (9) of 2018 on Public Debt,
And Federal Decree-Law No. (26) of 2019 on Public Finance,
And based on the proposal of the Minister of Finance and the approval of the Cabinet,
We have issued the following Decree-Law:
Article One
The text of Article (11) of Federal Decree-Law No. (9) of 2018 on Public Debt shall be replaced by the following text:
Article (11)
Government Financial Guarantees
1. Without prejudice to the provisions of Article (6) of this Decree-Law, the Government may provide one or more government financial guarantees on behalf of a government entity based on the recommendation of the Minister and the approval of the Cabinet.
2. The Cabinet shall, based on the Minister's proposal, issue a decision specifying the terms and conditions governing the issuance of the government financial guarantee.
3. The Minister is authorized by virtue of this Decree-Law to issue the government financial guarantee required for the implementation of the Cabinet's decision stipulated in Clause (1) of this Article.
4. The Minister shall notify the Federal National Council of the guarantees provided by the Government in implementation of the provisions of this Article within a maximum of (30) thirty days from the date they are provided.
Article Two
This Decree-Law shall be published in the Official Gazette and shall come into force from the date of its issuance.
