القرار الأميري رقم (14) لسنة 2021
في شأن رسوم وعمولات مراكز الخدمة
نحن عمار بن حميد النعيمي ولي عهد إمارة عجمان
- بعد الاطلاع على القانون المالي لحكومة عجمان الصادر بالمرسوم الأميري رقم (11) لسنة 2011، ولائحته التنفيذية،
- وعلى المرسوم الأميري رقم (15) لسنة 2012 بشأن دائرة المالية في عجمان، وتعديلاته،
- وعلى المرسوم الأميري رقم (2) لسنة 2018 بشأن لجنة التشريعات في إمارة عجمان،
- وعلى المرسوم الأميري رقم (1) لسنة 2019 بشأن الرسوم والضرائب والغرامات في إمارة عجمان
وبناءً على موافقة لجنة التشريعات
أصدرنا القرار الآتي:
المادة (1)
التعريفات
يكون للكلمات والعبارات التالية أينما وردت في هذا القرار المعاني المبينة قرين كل منها، ما لم يقض سياق النص بغير ذلك:
الدولة: دولة الإمارات العربية المتحدة
الإمارة: إمارة عجمان
دائرة المالية:دائرة المالية في عجمان.
الرئيس:رئيس دائرة المالية.
الدوائر: الجهات الحكومية المدرجة موازنتها ضمن الموازنة العامة السنوية للحكومة.
المستحقات المالية: الضرائب والرسوم والغرامات، ولا يدخل ضمن المستحقات المالية مقدار الأثمان التي تحصلها مراكز الخدمة.
الرسم: مورد مالي يتم تحصيله من قبل الدوائر نظير الخدمات العامة التي تنفرد بتقديمها للأفراد والشركات والمؤسسات وغيرها من الجهات.
العمولة:عمولة التحصيل التي يتقاضاها مزود الخدمة وفقاً لأحكام الاتفاقية المبرمة بينه وبين دائرة المالية.
الثمن: مورد مالي يتم تحصيله من قبل الجهة الحكومية نظير السلع والخدمات التي تقدمها للأفراد والشركات والمؤسسات وغيرها من الجهات على أسس تجارية وتنافسية.
مراكز الخدمة: مراكز الخدمة التابعة للدوائر.
مراكز مزودي الخدمة : مراكز الخدمة غير التابعة للدوائر .
قنوات الدفع:المنافذ التي يتم من خلالها دفع المستحقات المالية للدوائر وتشمل مراكز الخدمةوالقنوات الرقمية ومراكز مزودي الخدمة.
طرق الدفع: وسائل الدفع التي يتم من خلالها دفع المستحقات المالية للدوائر، وتشمل بطاقات الائتمان ومحفظة عجمان (AJMAN WALLET والخصم المباشر من الحساب المصرفي والدرهم الإلكتروني والحوالات المصرفية والشيكات والدفع النقدي وأي وسائل معتمدة أخرى.
القنوات الرقمية: قنوات تقديم الخدمة الرقمية وتشمل المواقع الإلكترونية والتطبيقات الذكية وأكشاك الخدمة الذاتية وأجهزة الصراف الآلي.
المادة (2)
رسم مركز الخدمة
يستوفي مركز الخدمة رسماً قدره (10) دراهم عن كل معاملة يقوم بإنجازها يبلغ مقدار المستحقات المالية الواردة بها (100) درهم فأكثر، وتؤول حصيلة ذلك الرسم للدائرة مقدمة الخدمة.
المادة (3)
عمولة تحصيل مراكز مزودي الخدمة
يستوفي مركز مزود الخدمة عمولة عن كل معاملة يقوم بإنجازها وفقاً للشروط والضوابط والعمولة التي يحددها الرئيس.
المادة (4)
الإلغاءات
يُلغى أي نص أو حكم ورد في أي قرار آخر يتعارض مع أحكام هذا القرار.
المادة (5)
السريان والنشر
يُعمل بهذا القرار اعتباراً من تاريخ 2021/08/15 ، ويُنشر في الجريدة الرسمية.
صدرعنا في هذا اليوم الخميس الموافق 19 من شهر ذي الحجة سنة 1442 هجرية الموافق 29 من شهر يوليو سنة 2021 ميلادية.

Regarding Fees and Commissions of Service Centers
We, Ammar bin Humaid Al Nuaimi, Crown Prince of the Emirate of Ajman
- Having reviewed the Financial Law of the Government of Ajman issued by Emiri Decree No. (11) of 2011, and its executive regulations,
- And Emiri Decree No. (15) of 2012 concerning the Department of Finance in Ajman, and its amendments,
- And Emiri Decree No. (2) of 2018 concerning the Legislation Committee in the Emirate of Ajman,
- And Emiri Decree No. (1) of 2019 concerning Fees, Taxes, and Fines in the Emirate of Ajman
And based on the approval of the Legislation Committee
We have issued the following decision:
Article (1)
Definitions
The following words and phrases, wherever they appear in this Decision, shall have the meanings assigned to each of them, unless the context requires otherwise:
The State: The United Arab Emirates
The Emirate: The Emirate of Ajman
Department of Finance: The Department of Finance in Ajman.
The Chairman: The Chairman of the Department of Finance.
The Departments: Government entities whose budgets are included in the annual general budget of the Government.
Financial Dues: Taxes, fees, and fines, and does not include the amount of prices collected by service centers.
Fee: A financial resource collected by the Departments in return for public services they exclusively provide to individuals, companies, institutions, and other entities.
Commission: The collection commission charged by the service provider in accordance with the provisions of the agreement concluded between it and the Department of Finance.
Price: A financial resource collected by the government entity in return for goods and services it provides to individuals, companies, institutions, and other entities on a commercial and competitive basis.
Service Centers: Service centers belonging to the Departments.
Service Provider Centers: Service centers not belonging to the Departments.
Payment Channels: The outlets through which financial dues are paid to the Departments, including service centers, digital channels, and service provider centers.
Payment Methods: The means through which financial dues are paid to the Departments, including credit cards, Ajman Wallet (AJMAN WALLET), direct debit from a bank account, e-Dirham, bank transfers, checks, cash payment, and any other approved means.
Digital Channels: Digital service delivery channels, including websites, smart applications, self-service kiosks, and ATMs.
Article (2)
Service Center Fee
The service center shall collect a fee of (10) dirhams for each transaction it completes where the financial dues amount to (100) dirhams or more, and the proceeds of that fee shall go to the Department providing the service.
Article (3)
Collection Commission for Service Provider Centers
The service provider center shall collect a commission for each transaction it completes in accordance with the conditions, regulations, and commission specified by the Chairman.
Article (4)
Repeals
Any text or provision contained in any other decision that contradicts the provisions of this Decision is hereby repealed.
Article (5)
Entry into Force and Publication
This Decision shall come into force as of 15/08/2021, and shall be published in the Official Gazette.
Issued by us on this day, Thursday, the 19th of Dhul-Hijjah 1442 AH, corresponding to the 29th of July 2021 AD.
